RECOMMENDATION

Staff recommends that City Council adopt the 573rd Amendment to the Master Fee Schedule Resolution No. 80-420 in order to capture language and segmented rates that were absent in the Master Fee Schedule Exhibit A submitted in conjunction with the 572nd Amendment.

EXECUTIVE SUMMARY

The attached Resolution to adopt the 573rd Amendment to the Master Fee Schedule (MFS) Resolution No. 80-420 adds language and segmented rates to the Master Fee Schedule Exhibit A, providing greater clarification for the fees approved per the 572nd Amendment.

BACKGROUND

Changes are highlighted in red on the attached Exhibit A. At the top of the fee schedule referencing to rates and overtime uses of the Tower Theatre shall be at the discretion of the Operator, new language has been added that the Operator's decision will be based on objective criteria.

Segmented rates provide for evening events less than six hours, as indicated from 6pm to 9pm and from 6pm to 10pm, at rates equivalent to 50% and 66%, respectively, of the six-hour 6pm to midnight rate.

Additional language was also added to clarify requirements to qualify for the discounted non-profit rate. Lastly, "Insurance" was added to "Bond/Insurance" requirement line and noted as subject to Theatre use policy.

ENVIRONMENTAL FINDINGS

This is not a project pursuant to CEQA guidelines Section 15378.

LOCAL PREFERENCE

Local preference was not implemented as this amendment to the MFS does not include a bid or award of a construction or service contract.
