RECOMMENDATION

Staff recommends the City Council adopt the attached Resolution rescinding and replacing Resolution No. 2009-80 regarding City Policy on the Distribution and Use of the Tickets and Skybox for the Multipurpose Stadium (Chukchansi Park).

EXECUTIVE SUMMARY

The proposed Resolution reflects the new organizational changes that have taken place within the City. The distribution procedure has been streamlined to make it more flexible.

BACKGROUND

Under the terms of the Agreement with Fresno Grizzlies, Inc., concerning the construction and sublease of the multipurpose stadium, the City has use of 12 season tickets within the skybox during the Grizzlies' regular season home games and the tickets are public resources. Title 2 of the California Code of Regulations section 18944.1 required the City to adopt an official policy regulating the distribution and use of the tickets and skybox provided to the City. On May 17, 2002, the City Council approved Resolution Number 2002-164 which established "The Official City Policy on the Use of the Tickets and Skybox for the Multipurpose Stadium" so that the use of the tickets and skybox were not considered gifts to the public officials under the Political Reform Act.
