Actions pertaining to the Taxiway C Reconstruction Project at Fresno Yosemite International Airport (Council District 4)
1. Adopt a finding of Categorical Exemption pursuant to Section 15301/Class 1 (Existing Facilities) of the California Environmental Quality Act Guidelines for the Taxiway C Reconstruction
2. Approve Change Order No. 2 for Phase 2 of the Taxiway C Reconstruction Project, for Add-Alternates 1 and 2 of Bid File 3519, with Security Paving, Inc., in the amount of $8,763,647
3. Authorize the Director of Aviation to execute additional Project Contract Change Order(s) not to exceed Project contingency funding of $2,183,389 and 66 Contract Days

RECOMMENDATION
Staff recommends Council adopt a finding of Class 1 Categorical Exemption pursuant to Section 15301 (Existing Facilities) of the California Environmental Quality Act (CEQA) Guidelines, and authorize the Director of Aviation to execute (i) Contract Change Order (CCO) No. 2 for $8,763,647 and 120 additional contract days, and (ii) additional Contract Change Order(s) not to exceed Project contingency funding of $2,183,389 and 66 contract days for the Taxiway C Reconstruction project at Fresno Yosemite International Airport (FAT).
EXECUTIVE SUMMARY
On October 12, 2017, Council awarded a contract to Security Paving Company, Inc., (Security) of Sylmar, California (Bid File 3519) for the Taxiway C Reconstruction Project at FAT, which includes removing and replacing existing pavements, lighting, markings and drainage facilities. The Federal Aviation Administration (FAA) provided an initial grant of $13,324,428 for the Base Bid and Additive Alternate No. 3 (Phase 1). The construction contract for Phase 1 has been executed and the work is underway. As part of a planned multi-phased effort, the FAA has issued a second grant in the amount of $9,119,970, which will provide funding to complete the Project. CCO No. 2 will award Add-Alternates No. 1 & 2 (Phase 2) to Security Paving in the amount of $8,763,647 as originally bid in May 2017. Upon approval of CCO No. 2 the total contract amount will be $21,833,889.
Staff also seeks Council authorization for the Director of Aviation to execute additional Project CCO(s) not to exceed contingency funding of $2,183,389 and 66 contract days. This authority delegation is necessary to provide a method for timely execution of CCOs that may result during construction of the Project and would not require further Council approval under the City’s CCO Resolution No. 2017-158. This action will enable the Project to be executed such that, (i) grant funds are expended consistent with FAA guidelines, (ii) disruption to normal Taxiway C operations are minimized, and, (iii) construction administration activities can be effectively integrated with other time critical projects.
BACKGROUND
As outlined in the October 12, 2017, Council Report for Phase 1, this Project was designed and bid in five distinct components (Base Bid, and Add-Alternates 1-4), per the FAA’s request based on funding streams between federal fiscal years. The five components included (i) Base Bid - storm drainage facilities and related work, (ii) Add-Alternate No. 1 - west end Taxiway C reconstruction and related work, (iii) Add-Alternate No. 2 - middle section of Taxiway C reconstruction and related work, (iv) Add-Alternate No. 3 - east end Taxiway C reconstruction and related work, and, (v) Add-Alternate No. 4 - reconstruct west end of Taxiway C aircraft holding area with concrete to better accommodate Air National Guard (ANG) operations. The Bid documents required the contractor to hold their Add-Alternate prices for the duration of the Project. Security Paving was the lowest responsive and responsible bidder for the total Project including the Base Bid and all Add-Alternates.
The FAA initially programed funds to award the Base Bid and Add-Alternate No. 3 ($13,070,242), which was awarded on October 12, 2017. As anticipated, the FAA has made available additional funds for Add-Alternates No. 1 and 2 ($8,763,647) and CCO 2 is needed to enter in to a supplemental agreement for the work. Should the ANG provide additional funding for Add-Alternate No. 4 prior to completion of the Project, Airports may request Council approval of an additional CCO.
Upon review of the original bid results, the FAA has (i) determined the bidding process was performed in accordance with required federal regulations, (ii) concurred with our recommendation to award to Security Paving, and, (iii) authorized the Department of Airports to issue contract change order(s) to Security Paving for the entire Taxiway C project as described herein.
CCO No. 1 was for $14,400 and was executed in early August due to an unforeseen condition related to FAA communications cabling.
The $10,947,036 CCO authorization request represents the difference between the awarded contract amount ($13,070,242) and the new Project cost ($21,833,889) plus a 10% construction contingency fund, consistent with the City’s CCO Resolution No. 2017-158. The 186 calendar day increase in contract time represents the difference between the awarded contract time (210 calendar days) and the new contract time (330 calendar days) plus 20%, also consistent with the City’s CCO Resolution No. 2017-158.
ENVIRONMENTAL FINDINGS
Staff has determined that this project falls within the Class 1 Categorical Exemptions set forth in the CEQA Guidelines, Article 19, Section 15301 (Existing Facilities), as it involves the restoration or rehabilitation of existing pavement surfaces. Furthermore, staff has determined none of the exceptions to Categorical Exemptions set forth in the CEQA Guidelines, Section 15300.2 apply to this project. In addition, the FAA has determined the proposed project is Categorically Excluded pursuant to FAA Order 1050.1F as it relates to National Environmental Policy Act of 1969, as amended (NEPA). Therefore, no further federal environment disclosure documentation for this project is necessary for NEPA purposes.
LOCAL PREFERENCE
Local Preference does not apply because federal funding is being used.
FISCAL IMPACT
Funding for the entire project, including CCO No. 2, was appropriated at time of initial award in FY18 and includes use of FAA Airport Improvement Program grants, matching Measure C Regional Transportation Program funds and potentially the Air National Guard funds. Taxiway C Reconstruction Project is part of the Department’s ongoing commitment to ensure FAT remains operationally ready and is properly positioned for local and regional growth. The Project is providing approximately 150 construction related jobs. There is no impact to the General Fund from this action.
