RECOMMENDATIONS

 

Staff recommends that Council:

1.                     Adopt finding of Categorical Exemption pursuant to sections 15301(c), 15301(d) and 15301(e) of the California Environmental Quality Act (CEQA) Guidelines

2.                     Approve a change order to the construction contract with Alliance Building Solutions, Inc. in the amount of $991,000 to provide and install 200 Immaculight-Illumipure ultraviolet disinfecting fixtures at various Parks, After School, Recreation and Community Services (PARCS) facility locations, and authorize the Public Works Director or designee to sign and execute the standardized contract change order on behalf of the City of Fresno.

 

EXECUTIVE SUMMARY

 

Since March 19, 2020 the State of California has been in a fight against the COVID-19 virus which has caused many companies to close their doors in an effort to save lives.  The City of Fresno wishes to install 200 Immaculight-Illumipure ultraviolet disinfecting fixtures at various PARCS facility locations.  Studies by various scientists have indicated that airborne microdroplets remain in the air causing substantial opportunities for people to become infected.  The Immaculight-Illumipure fixtures kill bacteria, mold, fungal spores, viruses (including COVID-19, MERS, SARS) and destroys volatile organic compounds continuously.  Installation of these fixtures at various PARCS facilities are expected to improve safety and reduce risk of infection.

 

BACKGROUND

 

On November 7, 2019 Council approved an agreement with Alliance Building Solutions, Inc. for an Energy Efficiency Program and equipment including, but not limited to, efficient lighting, air-conditioning and control and monitoring systems, roof replacement, elastomeric coating and solar panels for implementation of certain energy related and sustainability services.   The City of Fresno would like to issue Alliance Building Solutions, Inc. a construction change order to include the installation of Immaculight-Illuminipure ultraviolet disinfecting fixtures at various City of Fresno PARCS facility locations pursuant to the COVID-19 Airborne Letter dated July 10, 2020, from the WHO Collaborating Centre of Queensland University of Technology and Applied Environmental Health, University of Maryland School of Public Health, to mitigate airborne transmission of the COVID-19 virus. 

 

Studies by the signatories of the letter and other scientists have demonstrated beyond any reasonable doubt that the virus is released during exhalation, talking, and coughing in microdroplets small enough to remain aloft in air and pose a risk of exposure at distances beyond six feet from an infected individual.  While hand washing and social distancing are appropriate they are insufficient to provide protection from virus-carrying respiratory microdroplets released into the air by infected people.  This problem is especially acute in indoor or enclosed environments particularly those that are crowded and have inadequate ventilation relative to the number of occupants and extended exposure periods. 

 

The Immaculight-Illumipure ultraviolet disinfecting fixtures disinfect and destruct the airborne pathogens using photo-electrochemical high-energy UVA light destruction and end-stage filtration.  The fixtures continuously disinfect with visible wavelength spikes and meet or exceed CDC-recommended standards for total room air changes.  The fixtures kill bacteria, mold, fungal spores, viruses (including COVID-19, MERS, SARS) and destroys volatile organic compounds continuously.

 

Staff recommends that Council adopt a finding of Categorical Exemption and approve a contract change order to Alliance Building Solutions, Inc. in the amount of $991,000 for the installation of 200 Immaculight-Illumipure ultraviolet disinfecting fixtures at various PARCS facility locations and authorize the Public Works Director or designee to sign and execute the standardized change order on behalf of the City of Fresno.

 

ENVIRONMENTAL FINDINGS

 

Staff has performed a preliminary environmental assessment of this project and has determined that it falls within the Categorical Exemption set forth in CEQA Guidelines Section 15301(c), 15301(d), and 15301, which exempts the repair, maintenance, or minor alteration of existing structures or facilities, with no further expansion of existing use. Furthermore, staff has determined that none of the exceptions to Categorical Exemptions set forth in the CEQA Guidelines, Section 15300.2 apply to this project.

 

LOCAL PREFERENCE

 

Local preference was not implemented because this is a change order to an existing contract.

 

FISCAL IMPACT

 

The total change order amount of $991,000 is CARES Act eligible.
