RECOMMENDATION

 

Staff recommends Council approve Contract Change Order 04 in the amount of $132,418.10 and an increase in contract time of two (2) additional days with W.M. Lyles Co. for the Waste Gas Flare Project (Project ID TC00159).

 

EXECUTIVE SUMMARY

 

Staff recommends Council approve Contract Change Order 04 in the amount of $132,418.10 and two (2) additional days for the waste Gas Flare Project to relocate a 16” digester line above ground to avoid conflict with underground utilities.  Additional potholing is required for unforeseen site conditions and a water line needs to be relocated due to conflicts. An additional concrete mow curb will need to be installed at the transitions between the grass and site surfacing.  None of this work was identified in the contract documents.

 

BACKGROUND

 

On December 9, 2021, a Contract was awarded in the amount of $6,395,900.00 to W.M Lyles Co., for the Waste Gas Flare Project at the Fresno-Clovis Regional Wastewater Reclamation Facility; the Notice to Proceed was issued with the start date of March 9, 2023, and completion date on April 11, 2023. There have been three (3) Contract Change Orders executed to date totaling $118,641.04, resulting in a Revised Contract Price in the amount of $6,514,541.04. There have been twenty-nine (29) days added to the Contract Time by executed Contract Change Orders, seventeen (17) approved weather days and twenty (20) suspension days resulting in a Revised Contract Completion Date of July 14, 2023.

 

Due to unforeseen site conditions, Wastewater plant staff and consultant (Carollo Engineers, Inc) redesigned the 16” digester line tie-in to be relocated above ground to avoid conflict with underground utilities. Additionally, the proposed 6” digester line at the north side of the site was eliminated from the scope of work.

 

Several underground utilities have been discovered in the project work area that were unforeseen prior to starting. Many of the discovered lines conflict with the proposed design for the project, and therefore required extensive additional potholing to identify and trace utilities.

 

After initial potholing was performed, and utilities were confirmed, a water line needed to be adjusted. The 6” digester line needs to be capped, demolished, and removed downstream. The 8” line needs to be capped on both ends and abandoned. The 1” water line needs to be removed and rerouted near the electrical room.

 

Plant staff requested to have the contractor install additional concrete mow curb at the transitions between the grass and site surfacing to protect from heavy equipment.

 

ENVIRONMENTAL FINDINGS

 

On September 2, 2021, the City Council adopted a Mitigated Negative Declarations (MNDs) for this project with Environmental Assessment No. P20-00072, dated May 25, 2021, a Mitigated Negative Declaration for the Regional Wastewater Reclamation Facility Waste Gas Flare Project pursuant to the California Environmental Quality Act (CEQA). Notice of Determination for the MND was filed with State Clearinghouse on October 28, 2021. Based upon these findings, it has been determined that no further environmental documentation is required for this Project.

 

LOCAL PREFERENCE

 

Local preference was not implemented as the lowest responsive and responsible bidder is a local business.

 

FISCAL IMPACT

 

There is no impact to the General Fund. This Project is in Council District 3. Funds for the construction of the Waste Gas Flare improvements are included in the Wastewater Division’s Fiscal Year 2023 Capital Improvement Program budget within the Wastewater Enterprise Fund 40501.
