Staff recommends City Council approve the Second Amendment to the Professional Engineering Services Agreement with Community Works Design Group in the amount of $21,860, increasing the total contract amount to $761,500, with a remaining contingency of $50, for design and construction support services related to roadway improvements for Dolores Huerta Park (formerly Milburn and Dakota Park) Project.
EXECUTIVE SUMMARY
The City of Fresno (City) awarded a Professional Engineering Services Agreement to Community Works Design Group (CWDG) on June 30, 2022, to prepare plans, specifications, and estimates for a new park located on the northeast corner of North Milburn Avenue and West Dakota Avenue. After a review of the initial design plan by the City’s Department of Public Works, additional roadway improvements were identified as conditions of approval for the project. Staff recommends approval of the Second Amendment to the Professional Engineering Services Agreement in the amount of $21,860, to provide the additional engineering services needed to complete the design of the roadway improvements required for project approval. The Consultant will also revise the approved Mitigated Negative Declaration (MND) to include the required roadway improvements. The project is funded by a combination of Proposition 68 grant funds and Park Impact Fees.
BACKGROUND
The City of Fresno Parks, After School, Recreation and Community Services Department (PARCS) initiated a new park development project to construct a multi-use field, multi-use sport, playground, irrigated landscaping, skate park, water play area, restroom, walking path, dog park, and exercise area. On June 30, 2022, Council approved the Professional Engineering Services Agreement between the City and CWDG which included the following scope of work: develop plans for the new park amenities, provide cost estimates, specifications, bidding, and construction support services. Services also included obtaining approvals from the City of Fresno Building and Safety Division. After an initial review of the geometric design plan for the proposed roadway improvements, additional required roadway improvements were identified and included in the conditions of approval for the project. The additional improvements will reconstruct the roadway per current City standards and will provide the safest roadway layout for ingress and egress to the park, as well as for the through-traffic traveling on Dakota Avenue.
The original Professional Engineering Services Agreement dated June 30, 2022, allocated a total amount of $689,690 with a contingency amount of $50,000. The First Amendment to the original Professional Engineering Services Agreement dated November 9, 2023, utilized an available contingency of $49,950 to include services for developing a landscape maintenance plan and expedited design services related to the new electrical service from PG&E.
Staff now recommends approval of the Second Amendment to the Professional Engineering Services Agreement with CWDG for $21,860, increasing the total contract to $761,500, with a remaining contingency of $50, to include the roadway improvements and authorize the Capital Projects Director or designee to execute the amendment to the original agreement on behalf of the City.
The City Attorney’s Office has reviewed and approved the proposed amendment as to form.
ENVIRONMENTAL FINDINGS
Contract amendment does not qualify as a project pursuant to California Environment Quality Act (CEQA) Guidelines § 15378.
LOCAL PREFERENCE
Local preference was not implemented during the selection process because of state funding.
FISCAL IMPACT
The project is in Council District 1. The project is funded by a combination of Proposition 68 grant funds and Park Impact Fees and there is no impact to the General Fund.
