RECOMMENDATION
Staff recommends City Council approve the First Amendment to the Professional Engineering Services Agreement with Michael K. Nunley & Associates, Inc., (MKN) of Fresno, California, in the amount of $12,710, increasing the total contract amount to $624,379, with a remaining contingency amount not to exceed $6,647, due to an increased scope of services for the Southwest Recycled Water System Storage Tank and Booster Pump Station Project (Project) and authorize the Capital Projects Director or designee to sign and execute the First Amendment on behalf of the City of Fresno (City).
EXECUTIVE SUMMARY
The Department of Public Utilities (DPU) has contracted with MKN to design a new recycled water storage tank, booster pump station, and all associated appurtenances at 3315 West Franklin Avenue. The site improvements will ensure adequate pressure for the City’s recycled water system and continued service reliability for recycled water delivery. Additionally, these improvements will allow for future expansion to reach those wishing to make use of recycled water. The First Amendment to the Professional Engineering Services Agreement will expand the scope of services to include support through the construction document phase of the Project. The expanded services will relocate all project improvements south of the Franklin Avenue right-of-way. Moving the project improvements will allow for the expedited preparation of construction documents in order to award a construction contract in the current fiscal year. The contract amendment for professional engineering design services will be funded with appropriations from the Wastewater Management Division’s Five-Year Capital Improvement Program budget within the Sewer Enterprise Fund.
BACKGROUND
The demand for recycled water has grown substantially over the past several years due to the communities increased awareness of the need for drought remediation measures. The growing demand has resulted in reduced pressure within the City’s recycled water system. On March 28, 2022, Council approved a Professional Engineering Services Agreement with MKN which included design and construction support for a new recycled water storage tank, booster pump station, and all associated appurtenances. The project would ensure the City’s recycled water system has adequate pressure to deliver recycled water to future stakeholders downstream of the booster pump station site. Initially, a transformer, needed to power the new booster pump station, was to be constructed within the County of Fresno’s right-of-way. The layout also included a space for a future antenna. In order to construct the improvements, the City is required to obtain right-of-way property via the street vacation of Franklin Avenue by the County of Fresno. The County of Fresno vacation process is time consuming and poses a risk to the project schedule. The Capital Projects Department (CPD) seeks to move the location of the transformer and antenna to property currently owned by the City of Fresno so that a delay in acquiring the necessary right-of-way does not impact the construction start date. Additional work was previously authorized by the DPU Director which expended a portion of the contingency in the amount of $49,353.
Pursuant to these goals, staff now recommends approval of the First Amendment to the Professional Engineering Services Agreement with Michael K. Nunley & Associates, Inc., of Fresno, California, in the amount of $12,710, increasing the total contract amount to $624,379, with a remaining contingency amount not to exceed $6,647, for the additional design services needed to relocate amenities for the Southwest Recycled Water System Storage Tank and Booster Pump Station Project, and authorize the Capital Projects Director or designee to sign and execute the First Amendment on behalf of the City. The contract amendment for professional engineering design services will be funded with appropriations from the Wastewater Management Division’s Five-Year Capital Improvement Program budget within the Sewer Enterprise Fund.
The City Attorney’s Office has reviewed and approved the proposed amendment as to form.
ENVIRONMENTAL FINDINGS
A contract amendment does not qualify as a project pursuant to California Environmental Quality Act (CEQA) Guidelines Section 15378.

FISCAL IMPACT
This Project is located in Fresno County and has no impact to the General Fund. Funding for the Project is included in the Wastewater Management Division’s Fiscal Year 2025 Capital Improvement Budget within the Sewer Enterprise Fund.
