Title
Actions pertaining to the Kaviland and Villa Park Improvements Project (Bid File 12402849) (Council District 5):
1. Adopt a finding of Categorical Exemption per staff’s determination, pursuant to Sections 15301/Class 1, 15302/Class 2, and 15303/Class 3 of the California Environmental Quality Act Guidelines, Environmental Assessment No. PW01041, for the Kaviland and Villa Park Improvements Project;
2. Award a construction contract in the amount of $220,713.75 to Geometric Construction, Inc. of Fresno, California, as the lowest responsive and responsible bidder for the Kaviland and Villa Park Improvements Project.

RECOMMENDATIONS
Staff recommends City Council (1) adopt a finding of Categorical Exemption per staff’s determination, pursuant to Sections 15301/Class 1, 15302/Class 2, and 15303/Class 3 of the California Environmental Quality Act (CEQA) Guidelines, Environmental Assessment No. PW01041, for the Kaviland and Villa Park Improvements Project, (2) award a construction contract in the amount of $220,713.75 to Geometric Construction, Inc. of Fresno, California as the lowest responsive and responsible bidder for the Kaviland and Villa Park Improvements Project, and authorize the Capital Projects Director or designee to sign and execute the construction contract on behalf of the City of Fresno (City).
EXECUTIVE SUMMARY
The adopted capital improvement budget for the Department of Public Works (DPW) includes improvements to the existing pocket park located on the southwest corner of East Kaviland Avenue and South Villa Avenue. These improvements will add amenities to allow the neighborhood community to use the park with increased accessibility and greater comfort. The scope of work includes the installation of benches, waste receptacles, tables, a drinking fountain, and a shade structure. Additionally, a new Americans with Disabilities Act (ADA) compliant path of travel will be constructed to ensure all new amenities are accessible. The construction contract will be funded utilizing dollars from the American Rescue Plan Act (ARPA) that were appropriated in the Fiscal Year 2025 (FY25) budget.
BACKGROUND
The Kaviland and Villa Park Improvements Project is located within Outlot B of Tract 5313. This tract subdivided approximately fifty-one (51) acres into a seventy-three (73) lot single family residential subdivision. The subdivision included an area of approximately one (1) acre at the southwest corner of East Kaviland Avenue and South Villa Avenue which was designed as an open space pocket park. The improvements project was initiated to meet the community’s need for new amenities such as new benches, tables, waste receptacles, a drinking fountain, and a shade structure. Additionally, a new ADA compliant path of travel will be constructed to improve accessibility throughout the park. The project design was completed by the Capital Projects Department’s in-house design team.
A Notice Inviting Bids was advertised and published on the City’s website, Planet Bids, and the Business Journal on July 10, 2024. The Project plans and specifications were distributed to eight (8) building exchanges and posted on the City’s website. Six (6) on-line bid proposals were received and publicly opened on August 6, 2024, with bid amounts ranging from $220,713.75 to $312,380.00 Geometric Construction, Inc. was determined to be the lowest responsive and responsible bidder in the amount of $220,713.75. The bids will expire on October 9, 2024. If the bids are rejected or expire, the Project must be rebid, which will result in a delay to the project.
The Community Workforce Agreement or Project Labor Agreement (PLA), adopted by Council in September 2021, does not apply to this contract because the engineer’s estimate for this project was less than $1 million, pursuant to the terms of the PLA.
Staff recommends Council adopt a finding of a Categorical Exemption per staff’s determination, pursuant to Sections 15301/Class 1, 15302/Class 2, and 15303/Class 3 of the CEQA Guidelines, Environmental Assessment No. PW01041, and award a construction contract in the amount of $220,713.75, to Geometric Construction, Inc. of Fresno, California as the lowest responsive and responsible bidder for the Kaviland and Villa Park Improvements Project, and authorize Capital Projects Director or designee to sign and execute the construction contract on behalf of the City of Fresno. The construction contract will be funded utilizing dollars from ARPA that were appropriated in the FY25 budget.
The City Attorney’s Office has reviewed and approved the standard construction contract as to form.
ENVIRONMENTAL FINDINGS
Staff has determined that a Categorical Exemption is appropriate based on Sections 15301/Class 1, 15302/Class 2, and 15303/Class 3 of the CEQA Guidelines. Section 15301/Class 1 consists of the operation, repair, maintenance, permitting, leasing, licensing, or minor alteration of existing public or private structures, facilities, mechanical equipment, or topographical features, involving negligible or no expansion of existing or former use.
Section 15302/Class 2 consists of replacement or reconstruction of existing structures and facilities where the new structure will be located on the same site as the structure replaced and will have substantially the same purpose and capacity as the structure replaced.
Section 15303/Class 3 consists of construction and location of limited numbers of new, small facilities or structures; installation of small new equipment and facilities in small structures.
Furthermore, staff has determined that none of the exceptions to Categorical Exemptions set forth in the CEQA Guidelines, Section 15300.2 apply to this Project. Staff recommends that Council, based upon its own independent judgment, adopt a finding of a Categorical Exemption per Staff’s determination, pursuant to Sections 15301, 15302, and 15303 of the CEQA Guidelines for the Kaviland and Villa Park Improvements Project.
LOCAL PREFERENCE
Geometric Construction, Inc. is a local business, as defined by the Fresno Municipal Code.
FISCAL IMPACT
The Kaviland and Villa Park Improvements project is located in Council District 5 and will have no impact to the General Fund. The Project will be funded utilizing dollars from the American Rescue Plan Act that were appropriated in the Fiscal Year 2025 budget.
