Actions pertaining to Orchid and Logan Park Improvements Project Bid File No. 12500687 (Council District 2):
1. Adopt a finding of Categorical Exemption per staff’s determinations, pursuant to Section 15301/Class 1 and 15302/Class 2 of the California Environmental Quality Act (CEQA) Guidelines, Environmental Assessment No. PC00302 and PC00413, for the Orchid and Logan Park Improvements Project;
2. Award a construction contract in the amount of $645,804.18 for the Base Bid only to Harris Development Corp. dba HBC Enterprises of Fresno, California, as the lowest responsive and responsible bidder for the Orchid and Logan Park Improvements Project.

RECOMMENDATIONS
Staff recommends that the City Council (1) adopt a finding of Categorical Exemption per staff’s determinations, pursuant to Section 15301/Class 1 and 15302/Class2 of the California Environmental Quality Act (CEQA) Guidelines, Environmental Assessment No. PC00302 and PC00413 and (2) award a construction contract to Harris Development Corp. dba HBC Enterprises of Fresno, California, in the amount of $645,804.18 for the Base Bid only as the lowest responsive and responsible bidder for the Orchid and Logan Park Improvements Project (Project) and authorize the Capital Projects Director or designee to sign the standardized construction contract on behalf of the City.
EXECUTIVE SUMMARY
The Capital Projects Department seeks to award a construction contract to Harris Development Corp. dba HBC Enterprises following a competitive bidding process which identified them as the lowest responsive and responsible bidder in the amount of $645,804.18 for the Base Bid only for the Orchid and Logan Park Improvements Project. The Project will construct playground shading as well as safety and accessibility improvements to enhance guests experience at both the Orchid and Logan Park project locations. The scope of work at Orchid Park involves installation of poured-in-place rubber surfacing, shade sail structures, signage, concrete flatwork and accessibility improvements. Additionally, the scope of work at Logan Park involves installation of poured-in-place rubber surfacing, pedestrian gate fencing, refurbishment of existing play equipment, signage, and accessibility improvements. The construction contract will utilize Fiscal Year (FY) 2025 American Rescue Plan Act (ARPA) and Measure P, Category 1 Citywide appropriations.
BACKGROUND
The City of Fresno Parks, After School, Recreation and Community Services Department (PARCS) proposes to construct playground shading as well as safety and accessibility improvements to enhance park guests experience at Orchid Park located north of Herdon Avenue and Prospect Avenue, and Logan Park located on the southeast corner of Wrenwood Avenue and Valentine Avenue. The scope of work at Orchid Park includes installation of poured-in-place rubber surfacing, shade sail structures, signage, concrete flatwork and accessibility improvements. Additionally, the scope of work at Logan Park includes installation of poured-in-place rubber surfacing, pedestrian gate fencing, refurbishment of existing play equipment, signage, and accessibility improvements. Pursuant to these goals, The City entered into an agreement with O’Dell Engineering Inc., on May 3, 2023, for design and preparation of the construction documents for the Project.
A Notice Inviting Bids was advertised and published in the Business Journal, Planet Bids, and posted on the City’s website on September 13, 2024. The Project plans and specifications were distributed to thirty-eight (38) prospective bidders and posted at eleven (11) building exchanges. Five (5) sealed bid proposals were received and opened in a public bid opening on October 17, 2024, with bid amounts ranging from $645,804.18 to $1,069,868.88. Harris Development Corp. dba HBC Enterprises was determined to be the lowest responsive and responsible bidder in the amount of $645,804.18 for the Base Bid only. The bids will expire on December 21, 2024. If the bids are rejected or expire, the Project must be rebid which will result in a delay to the Project.
The Community Workforce Agreement (PLA), adopted by Council in September 2021, does not apply to this contract because the engineer’s estimate for this project was less than $1 million, pursuant to the terms of the PLA.
Staff recommends that the City Council adopt a finding of Categorical Exemption per staff’s determinations, pursuant to Section 15301/Class 1 and 15302/Class 2 of the California Environmental Quality Act Guidelines, Environmental Assessment No. PC00302 and PC00413 and award a construction contract to Harris Development Corp. dba HBC Enterprises of Fresno, California, in the amount of $645,804.18 for the Base Bid only as the lowest responsive and responsible bidder for the Orchid and Logan Park Improvements Project and authorize the Capital Projects Director or designee to sign the standardized construction contract on behalf of the City. The Project will be funded utilizing FY 2025 ARPA and Measure P, Category 1 Citywide appropriations.
The City Attorney’s Office has reviewed and approved the contract documents as to form.
ENVIRONMENTAL FINDINGS
Staff performed an environmental assessment of this Project and determined that it falls within the Categorical Exemption set forth in CEQA Guidelines Sections 15301/Class 1 and 15302/Class 2 because the Project includes minor alterations to existing facilities and shall replace existing structures and facilities, with new structures being located on the same site as the structures replaced and will have substantially the same purpose and capacity with negligible or no expansion of use.
None of the exceptions to Categorical Exemptions set forth in CEQA Guidelines Section 15300.2 apply to this project. (Environmental Assessment)
LOCAL PREFERENCE
Local Preference was not implemented because of federal ARPA funding.
FISCAL IMPACT
The Orchid and Logan Park Improvements Project is in Council District 2 and will have no impact to the General Fund. The Project will be funded utilizing Fiscal Year 2025 American Rescue Plan Act and Measure P, Category 1 Citywide appropriations.
