RECOMMENDATION

 

Staff recommends City Council authorize the Chief of Police to execute the Second Amendment  to the Agreement between the County of Fresno and the City of Fresno to reimburse the City for one (1) Police Sergeant and two (2) Police Officers assigned to the Fresno County Adult Compliance Team (County ACT); adopt the First Amendment to the Position Authorization Resolution (PAR) No. 2016-119, adding two (2) Police Officer positions and one (1) Police Sergeant position to the Fresno Police Department, effective January 1, 2017; and adopt the 22nd Amendment to the Annual Appropriation Resolution (AAR) No. 2016-118 appropriating $377,600 for the Fresno Police Department’s Adult Compliance Team (City ACT). 

 

EXECUTIVE SUMMARY

 

One of the consequences of Assembly Bill 109, the Public Safety Realignment Act of 2011 (AB109), was the shifting of responsibility for supervising convicted criminals released from state prison facilities to county probation departments.  To accomplish this, funding was allocated from the State of California to the 58 counties through the Community Corrections Partnership (CCP) Boards established in each county.  The Fresno County CCP established an Adult Compliance Team (ACT) to ensure that convicted criminals are closely supervised after release.  A Fresno Police Officer has been part of the ACT Team since its inception in October 2011.

 

In January 2016, the City of Fresno and the County of Fresno entered into an agreement to continue the assignment of the one (1) Fresno police officer to fulfill the responsibilities of the ACT member as set forth by AB109 through June 2016.  The City of Fresno and the County of Fresno now desire to enter in the proposed Second Amendment to include two (2) additional police officers and one sergeant in the ACT Team.

 

The total compensation for the three (3) police officers, one (1) sergeant, equipment, and direct costs shall not exceed $734,180 for Fiscal Year 2016-17.

 

BACKGROUND

 

A Fresno Police Officer has been a part of the ACT Team since its inception in October 2011.  On June 2, 2016, Council approved the First Amendment to Agreement 16-030, which extends the provision of one (1) Police Officer for ACT through June 30, 2017.

 

The City of Fresno and the County of Fresno now desire to enter in the proposed Second Amendment to increase the Adult Compliance Team to include two (2) additional Fresno Police Officers and one (1) Police Sergeant, for a total of three (3) police officers and one (1) sergeant.

 

The Second Amendment states that the total compensation for the three (3) officers and one (1) sergeant, equipment, and indirect costs shall not exceed $734,180 for Fiscal Year 2016-2017; however, the new officers and sergeant will not be in place until January 2017, and the attached AAR pro-rates their costs.

 

ENVIRONMENTAL FINDINGS

 

This is not a “project” for the purposes of CEQA, pursuant to CEQA Guidelines Section 15378.

 

LOCAL PREFERENCE

 

Local Preference was not considered because accepting funding from the State does not include a bid or award of a construction or services contract.

 

FISCAL IMPACT

 

The Police Department’s FY 17 General Fund budget has appropriations of $136,600 for the original ACT police officer’s salary and fringe.  The attached AAR for $377,600 adds appropriations for the additional salary and fringe for the additional two (2) Police Officers and one (1) Sergeant, and also includes overtime, equipment, and indirect costs for all four positions.  All costs will be reimbursed by the County of Fresno.  This AAR establishes funding for the ACT program in the Patrol Support Fund (24036) for ease of tracking.  The total cost of the program will not exceed $514,200 in FY 17.
