Approve the First Amendment to the Consultant Services Agreement with Blair, Church, and Flynn Consulting Engineers, Inc., a California corporation of Clovis, to extend the term of the contract to December 31, 2026, without changing the compensation of the Agreement, for the Water Main Replacements in the area bound by Clinton, Teilman, University and West Avenues Project. RECOMMENDATION
Staff recommends City Council approve the First Amendment to the Consultant Services Agreement with Blair, Church, and Flynn Consulting Engineers, Inc. of Clovis (Consultant), to extend the term of the contract from December 31, 2024, to December 31, 2026, without changing the compensation of the Agreement, for the Water Main Replacements in the area bound by Clinton, Teilman, University and West Avenues Project (Project), and authorize the Capital Projects Director or designee to sign the First Amendment to the Consultant Services Agreement on behalf of the City of Fresno.
EXECUTIVE SUMMARY
On May 31, 2023, the Department of Public Utilities (DPU) entered into an agreement with the Consultant, in the amount of $187,894 with a contingency amount not to exceed $18,789 to provide engineering and construction support services for the Project. Construction advertising for the Project is scheduled to occur in 2025 and the First Amendment to the Consultant Services Agreement is now necessary to retain the Consultant’s services through Project completion.
BACKGROUND
DPU identified approximately 11,700-linear feet of 8-inch water mains and 6,200-linear feet of 12-inch water mains needing replacement within a neighborhood bound by West Clinton, North Teilman, West University, and North West Avenues. The water mains do not meet current standards and have outlived their life expectancy. The Project consists of the replacement of the existing water mains with 8-inch polyvinyl chloride and 16-inch ductile iron water mains as well as the transfer of approximately 218 water services for providing a more reliable water service and fire protection.
Pursuant to these goals, the City entered into a Consultant Services Agreement dated May 31, 2023, with the Blair, Church, and Flynn Consulting Engineers, Inc. in the amount of $187,894 with a contingency amount not to exceed $18,789 to provide design and construction support services for the Project. Advertising for the Project is scheduled to occur in 2025 and the First Amendment to the Consultant Services Agreement is now necessary to retain the Consultant’s services through Project completion.
Staff now recommends City Council approve the First Amendment to the Consultant Services Agreement with Blair, Church, and Flynn Consulting Engineers, Inc., of Fresno, California, to extend the term of the Agreement from December 31, 2024, to December 31, 2026, without changing the overall compensation of the Agreement, and authorize the Capital Projects Director or designee to sign the First Amendment to the Consultant Services Agreement on behalf of the City of Fresno.
The City Attorney’s Office has reviewed and approved the First Amendment to the Consultant Services Agreement as to form.
ENVIRONMENTAL FINDINGS
An Amendment to the Consultant Services Agreement does not qualify as a project pursuant to California Environmental Quality Act (CEQA) Guidelines 15378.
LOCAL PREFERENCE
Local preference does not apply to this action because this is an amendment to an existing Consultant Services Agreement.
FISCAL IMPACT
The Project is located in Council District 3 and will have no impact to the General Fund. Funding for the design contract was previously encumbered, and other ongoing Project costs will use funds appropriated in the Fiscal Year 2025 Water Enterprise Fund.
