Actions pertaining to the Radio Park Renovation Rebid Project (Bid File 12501299) (Council District 7):
1. ***RESOLUTION - Adopting the 3rd Amendment to the Annual Appropriation Resolution (AAR) No. 2025-179 reappropriating $8,113,300.00 of carryover funding for the Radio Park Renovation Rebid Project (Requires 5 Affirmative Votes) (Subject to Mayor’s Veto);
2. Award a construction contract in the amount of $9,177,239.80, for the Base Bid only, to American Paving Co. Inc. of Fresno, California, as the lowest responsive and responsible bidder for the Radio Park Renovation Rebid Project.

RECOMMENDATIONS
Staff recommends the City Council (1) adopt the 3rd Amendment to the AAR No. 2025-179 reappropriating $8,113,300.00 of carryover funding for the Radio Park Renovation Rebid Project, and (2) award a construction contract in the amount of $9,177,239.80, for the Base Bid only, to American Paving Co. Inc. of Fresno, California, as the lowest responsive and responsible bidder for the Radio Park Renovation Rebid Project (Project), and authorize the Capital Projects Director or designee to sign and execute the standardized contract on behalf of the City of Fresno (City).
EXECUTIVE SUMMARY
The Capital Projects Department (CPD) seeks to award a construction contract to American Paving Co. Inc. following a competitive bidding process which identified them as the lowest responsive and responsible bidder in the amount of $9,177,239.80, for the Base Bid only. The Project will revitalize and modernize Radio Park to enhance park guests experience, safety, and accessibility. The scope of work includes, but is not limited to, installation of a new splash pad, accessible play areas and walking paths, a play structure, picnic areas, shade structures, and replacement of the existing restroom building to support the new splash pad. The scope of work also includes landscaping improvements including the installation of new trees throughout the park, and expansion of the existing parking lot to include additional accessible parking spaces. The construction contract is funded utilizing Prop 68; Measure P, Expenditure Category 1; Park Impact Fees; and General Fund appropriations adopted in the Fiscal Year (FY) 2026 Budget. Due to the timing of award, approval of the 3rd Amendment to the AAR will reappropriate Project funding that is carried over from FY 2025.
BACKGROUND
The City of Fresno Parks, After School, Recreation and Community Services Department (PARCS) applied for and was awarded funding through the State Park Development and Community Revitalization Program (Prop 68 SPP Program) for park improvements at Radio Park, a 7.5-acre park located at the southwest corner of North First Street and East Clinton Avenue with a portion of the property leased to the Fresno Art Museum. The park layout currently includes a soccer field, small restroom facility, tot lot, benches, tables, and trash receptacles that are near the end of their lifecycle and in need of updating. Pursuant to these goals, PARCS initiated the design for the Radio Park Renovation Project.
On July 21, 2022, Council approved a Consultant Services Agreement with Melton Design Group, Inc. for the design and preparation of construction documents for the Project. The renovation Project will include improvements to existing facilities such as the replacement of the existing restroom building to include outdoor drinking fountains and shower facilities to support a new splash pad, play areas with accessible elements, accessible walking paths, additional trees throughout the park, expansion of the existing parking lot, additional picnic areas, and new perimeter fencing. Also included with the renovation is the construction of new amenities such as shade structures, seating, a play structure with slide, small stage, decorative art panels on the radio tower fencing, art kiosks, and concrete pad foundations for future sculptures or art pieces.
The Project was first advertised in July 2024, but was later rejected by City Council on October 31, 2024, because the lowest bid received was 38.52% above the engineer’s estimate. Staff revisited the construction documents to reduce the scope and complexity of the design to reduce the costs of the current bid.
A Notice Inviting Bids was advertised and published on the City’s website and Planet Bids on January 6, 2025. The Project plans and specifications were distributed to seventy-seven (77) prospective bidders and posted at ten (10) building exchanges. Six (6) on-line bid proposals were received and opened in a public bid opening on March 4, 2025, with bid amounts ranging from $7,522,600.80 to $9,884,546.00. The two apparent low bidders ultimately withdrew their bid and American Paving Co. Inc. was determined to be the lowest responsive and responsible bidder in the amount of $9,177,239.80, for the Base Bid only. The bids will expire on July 21, 2025. If the bids are rejected or expire, the Project must be rebid which will result in a delay to the Project.
This contract is covered by the Community Workforce Agreement (PLA), adopted by Council in September 2021. The Contractor shall become signatory to the PLA by executing the Agreement To Be Bound.

Inc. of Fresno, California, as the lowest responsive and responsible bidder for the Radio Park Renovation Rebid Project and authorize the Capital Projects Interim Director or designee to sign and execute the standardized contract on behalf of the City of Fresno. The Project will be funded utilizing Prop 68; Measure P, Expenditure Category 1; Park Impact Fees; and General Fund appropriations adopted in the Fiscal Year FY2026 Budget
The City Attorney’s Office has reviewed and approved the contract documents as to form.
ENVIRONMENTAL FINDINGS
An Initial Study (IS) and Mitigated Negative Declaration (MND) was approved on March 11, 2021, as part of Environmental Assessment No. P19-03262 and Development Permit Application No. P21-00766.
A public notice of the Mitigated Negative Declaration was published on November 20, 2020, with no comments received, and a Notice of Determination was filed in compliance with Section 21152 of the Public Resources Code on March 11, 2021. It has been determined that no further CEQA compliance actions are required.
LOCAL PREFERENCE
American Paving Co. Inc. is a local business, as defined by the Fresno Municipal Code.
FISCAL IMPACT
The Radio Park Renovation Project is in Council District 7. The Project is funded utilizing Prop 68; Measure P, Expenditure Category 1; Park Impact Fees; and General Fund appropriations adopted in the FY 2026 Budget. AAR No. 2025-179 will reappropriate funding carried over from FY 2025 for the Project.
