RECOMMENDATION
Staff recommends City Council award a construction contract in the amount of $1,168,921.77 for the Base Bid only to Alliance Construction Solutions, Inc. of Madera, California for the Vinland Park Futsal and Pickleball Courts Project (Project), and authorize the Capital Projects Interim Director or designee to sign the standardized construction contract on behalf of the City of Fresno (City).
EXECUTIVE SUMMARY
The Capital Projects Department (CPD) seeks to award a construction contract to Alliance Construction Solutions, Inc. of Madera, California following a competitive bidding process in the amount of $1,168,921.77 for the Base Bid only. The scope of work includes the construction of four pickleball courts, one futsal court, picnic tables and benches at Vinland Park. The additive alternates that are not included are the shade structure and 2 drinking fountains. The Project will be funded utilizing Fiscal Year 2025 appropriations from American Rescue Plan Act (ARPA) and Measure P, Category 1 funding.
Previously the City Council awarded a contract with Estate Design to encumber the ARPA funds. They failed to meet the city requirements and the contract was cancelled. The action here is awarding to the second bidder.
BACKGROUND
Vinland Park is located on the northwest corner of Gettysburg and Woodrow Avenues. The City of Fresno Parks, After School, Recreation and Community Services Department (PARCS) proposes to construct four pickleball courts, one futsal court, picnic tables and benches. The Project will support the growth of the pickleball and futsal communities in the surrounding area and will cultivate an environment that promotes health and social interaction.
On June 22, 2023, Council approved a Consultant Services Agreement with Quad Knopf, Inc., to develop construction drawings for the Vinland Park Futsal and Pickleball Courts Project. CPD now seeks to award a construction contract to construct the proposed improvements.
A Notice Inviting Bids was advertised and published on the City’s website, Planet Bids and the Business Journal on September 20, 2024. The Project plans and specifications were distributed to 41 prospective bidders and posted at Eleven (11) Building Exchanges. Five (5) sealed bid proposals were received and publicly opened on October 22, 2024, with bid amounts for the Base Bid plus all two (2) add alternates ranging from $998,000.00 to $1,587,991.70.
On November 21, 2024, City Council approved the construction contract in the amount of $998,000 for the Base Bid plus all two (2) Add Alternates, to Estate Design and Construction of Los Angeles, California for the Vinland Park Futsal and Pickleball Courts Project. The City of Fresno and Estate Design and Construction entered into an Agreement on December 18, 2024. Following execution, the contractor failed to provide the required insurance and bonding documentation. Despite multiple attempts by staff to obtain the necessary documents and assist the contractor in complying, Estate Design and Construction, Inc. remained noncompliant. Their continued failure to meet contractual requirements prevented the commencement of work and constituted a material breach of contract. On April 3, 2025, a termination letter was sent to the Estate Design and Construction, Inc.
In accordance with Page 2.37 Division II - General Conditions, failure to submit required documents within the specified timeframe (15 calendar days from the Notice of Award, or 10 working days if federal funds are involved) provides sufficient cause for the City to recommend award to the next lowest responsive and responsible bidder. Required contract documents include, but are not limited to: the Executed Contract, Payment and Performance Bonds, Insurance Certificates, Workers' Compensation Insurance Certificate, Fair Employment Practices Form, and any other documents required by the specifications.
Staff recommends that the Council award a construction contract in the amount of $1,168,921.77 for the Base Bid only, to Alliance Construction Solutions, Inc. of Madera, California for the Vinland Park Futsal and Pickleball Courts Project, and authorize the Capital Projects Interim Director or designee to sign the standardized construction contract on behalf of the City. Due to the difference in cost of the next lowest bidder, the project budget is sufficient to award the Base Bid only and will not include the two (2) Add Alternates. The Project will be funded utilizing Fiscal Year 2025 appropriations from ARPA and Measure P, Category 1 funding.
This contract is subject to the Community Workforce Agreement (PLA), adopted by Council in September 2021. The Contractor shall become signatory to the PLA by executing the Agreement To Be Bound.
The City Attorney’s Office has reviewed and approved the contract documents as to form.
ENVIRONMENTAL FINDINGS
On November 21, 2024, Council adopted the finding of Common Sense Categorical Exemption per staff’s determination pursuant to section 15061(b)(3) of the California Environmental Quality Act Guidelines for the Vinland Park Futsal and Pickleball Courts Project. This exemption applies based on the analysis provided by Staff that there is no possibility that the Project activities would have a significant impact on the environment. The Notice of Exemption has been filed with the County of Fresno Clerks Office and State Clearinghouse.
LOCAL PREFERENCE
Local Preference was not implemented because of Federal ARPA funding.
FISCAL IMPACT
The Vinland Park Futsal and Pickleball Courts Project is in Council District 4 and will have no impact to the General Fund. The Project will be funded utilizing Fiscal Year 2025 appropriations from ARPA and Measure P, Category 1 funding.
