RECOMMENDATION
Staff recommends City Council approve the First Amendment to the Consultant Services Agreement with OMNI Design, Inc. (Consultant) of Fresno, California, to extend the term of the contract from December 29, 2024, to December 31, 2026, without changing the compensation of the Agreement, for the Design of Materials Storage Buildings at the Fresno-Clovis Regional Wastewater Reclamation Facility (RWRF) Project (Project), and authorize the Capital Projects Director or designee to sign the First Amendment to the Consultant Services Agreement on behalf of the City of Fresno.
EXECUTIVE SUMMARY
On June 21, 2023, the Department of Public Utilities entered into an agreement with OMNI Design, Inc., of San Luis Obispo, California, in the amount of $188,843 with a contingency amount not to exceed $18,885 to provide engineering and construction support services for the Design of Materials Storage Buildings at the Fresno-Clovis RWRF Project. Construction advertising for the Project is scheduled to occur in 2025 and the First Amendment to the Consultant Services Agreement is now necessary to retain the Consultant’s services through Project completion. Funding for this Project is included in the Fiscal Year 2025 Wastewater Enterprise Fund.
BACKGROUND
The Wastewater Management Division (WMD) is responsible for the collection, conveyance, treatment, and reclamation of wastewater generated by the residential, commercial, and industrial sewer customers in the Fresno-Clovis metropolitan area. All the heavy equipment vehicles used in the maintenance and repair of WMD assets no longer fit under the existing prefabricated steel canopy buildings and RWRF requires additional canopies to protect and house these City assets. WMD seeks to build two new prefabricated steel canopy buildings, improve existing storage buildings to properly store used and recovered parts, retrofit an existing canopy building for the installation of car wash equipment for WMD vehicles, and design a centralized WMD electronic waste and used oil containment structure to safely store the waste until proper disposal.
Pursuant to these goals, the City entered into a Consultant Services Agreement dated June 21, 2023, with OMNI Design, Inc., of San Luis Obispo, California in the amount of $188,843 with a contingency amount not to exceed $18,885 to provide design and construction support services for the Project. Advertising for the Project is scheduled to occur in 2025 and the First Amendment to the Consultant Services Agreement is now necessary to retain the Consultant’s services through Project completion.

The Project will be funded utilizing appropriations from the Wastewater Enterprise Fund adopted in the Fiscal Year 2025 Budget.
The City Attorney’s Office has reviewed and approved the First Amendment to the Consultant Services Agreement as to form.
ENVIRONMENTAL FINDINGS
An Amendment to the Consultant Services Agreement does not qualify as a project pursuant to California Environmental Quality Act (CEQA) Guidelines 15378.
LOCAL PREFERENCE
Local preference does not apply to this action because this is an amendment to an existing Consultant Services Agreement.
FISCAL IMPACT
The Design of Materials Storage Building at the Fresno-Clovis Regional Wastewater Reclamation Facility Project is located in Council District 3 and will have no impact to the General Fund. Funding for the design contract was previously encumbered, and other ongoing Project costs will use funds appropriated in the Fiscal Year 2025 Wastewater Enterprise Fund.
