RECOMMENDATION
 
Staff recommends that the City Council approve the Second Amendment to Agreement with TAM+CZ Architects in the amount of $865 to bring design up to 2013 Building Code standards for the Restrooms Remodeling, Re-roofing, and Electrical Panel Replacement at Parking Garage #7.
 
EXECUTIVE SUMMARY
 
On May 23, 2011 the Public Works Department entered into an agreement with TAM+CZ in the amount of $46,970 for professional architectural services for the design of plans and general construction documents for Restrooms Remodeling, Re-roofing, and Electrical Panel Replacement at Parking Garage #7, and as amended on November 18, 2011 in the amount of $3,000 for modifications on the re-roofing portion of the project, bringing the agreement total to $49,970.
 
The re-roofing has been completed and the electrical panel replacement has been deleted from the original scope of work.  Staff is now ready to go out to bid for the restrooms remodeling portion and the design needs to be brought up to current 2013 Building Code requirements.  Therefore, staff recommends City Council approve the Second Amendment to Agreement with TAM+CZ Architects in the amount of $865 bringing the agreement total to $50,835, and direct staff to bring the construction documents up to current 2013 Building Code standards.
 
BACKGROUND
 
On May 20, 2010 Council approved lease/debt financing which reimbursed the City's Treasury Cash Pool for payment of loans for the Met and Granite Park.  This financing cobbled City Hall and Garage 7 as collateral as well as the Met to secure the financing, and in doing so freed up equity in both City Hall and Garage 7 to perform immediate repairs required at both properties.  One of the immediate repairs was the remodeling and opening of the Garage 7 restrooms for use as Fulton Mall public restrooms.  Pursuant to Administrative Order (AO) 6-19 staff issued a request for qualifications on November 15, 2010 for professional architectural services for the Garage #7 upgrades and remodels.

ENVIRONMENTAL FINDINGS
 
By the definition provided in the California Environmental Quality Act (CEQA) Guidelines Section 15378, this item does not qualify as a "project" for the purposes of CEQA.
 
LOCAL PREFERENCE
 
Local preference was not implemented because this action is an amendment to an existing agreement.
 
FISCAL IMPACT
 
The project is fully funded by fund 30152 - 2010 Bonds issuance limited to improvements for Garage 7.  The General Fund will not be affected
