RECOMMENDATIONS
Staff recommends that City Council approve a consultant services agreement with ADS Corp, a Delaware corporation, for a term of one-year, with the option of four one-year extensions, in an amount not to exceed $1,086,249, to provide wastewater flow monitoring services for the City of Fresno; and authorize the Director of Public Utilities, or designee, to sign the agreement on behalf of the City of Fresno (City).
EXECUTIVE SUMMARY
Since 1985, the Department of Public Utilities (DPU) Wastewater Management Division (WMD) had collected data from flow meters at various locations throughout the City’s wastewater collection system for billing and master planning purposes. DPU now intends to enter into an Agreement with ADS Corp (formerly ADS Environmental Services) to process, store, and analyze the flow data collected from 25 meters. The services will also provide field services related to the procurement, installation, and maintenance of both existing and future flow meters. Under this Agreement, ADS Corp will provide the necessary services for the next five years. Flow meters and software are proprietary. Equipment and maintenance services have been supplied by ADS Corp, to the City for over 25 years. The four one-year extensions would each be equivalent in cost to the first-year agreement plus a 3% CPI increase. The propriety software will enhance reliability, accuracy, and ensure a minimum of 90% system up-time. Flow monitoring, equipment, and maintenance services have been supplied by ADS Corp to the City for past 25 years.
BACKGROUND
Wastewater Management Division uses sewer flow data to determine sewer mainline capacity for the existing and future customers. This information is also utilized to populate data into a Sewer Model for Master Planning efforts and develop potential fees for industrial users.
In accordance with Fresno Municipal Code Chapter 4, Article 1, and Administrative Order 6-19, the DPU conducted a Request for Qualifications (RFQ) process to select a consultant to provide the requisite professional services. On September 13, 2023, the RFQ was published in the Business Journal and posted on the City’s Planet Bids website. Two Statement of Qualifications (SOQs) were received by the submission deadline of October 6, 2023. A selection committee, consisting of representatives from the DPU Utilities Planning & Engineering Division and WMD evaluated the SOQ’s. Upon review of the qualifications and proposed fee, the committee selected ADS Corp. Staff recommends awarding a consultant services agreement to ADS Corp for a five year total amount not to exceed $1,086,249. Funding for this project is included in the Fiscal Year 2024 operating budget within the Wastewater Management Division’s Sewer Enterprise Fund 4500-4501.
The consultant services agreement has been approved by the City Attorney’s Office. Upon approval by the City Council, the consultant services agreement will be executed by the Director of Public Utilities, or designee.
ENVIRONMENTAL FINDINGS
By the definition of the California Environmental Quality Act (CEQA) Guidelines Section 15378, the award of this consultant services agreement is not a “Project” for the purposes of CEQA.
LOCAL PREFERENCE
Local preference was not implemented per Fresno Municipal Code Section 4-109(b)(3), as staff believes there are less than three local firms providing the specific consulting service within the area of expertise for the subject matter of work.
FISCAL IMPACT
There is no impact to the General Fund. Funding for this project is included in the Fiscal Year 2024 operating budget within the Wastewater Management Division’s Sewer Enterprise Fund 4500-4501. The project benefits are Citywide.
