Actions pertaining to the acquisition of three undeveloped properties by Assignment of Purchase and Sale Agreements for the development of affordable housing (District 3):

 

1.                     Approve Assignment of Purchase and Sale Agreement for the amount $192,000 from the Fresno Housing Authority for 1.03 acres of undeveloped land (APNs 44934203, 44934204, & 44934205).

2.                     Approve Assignment of Purchase and Sale Agreement for the amount of $69,000 from the Fresno Housing Authority for 0.28 acres of undeveloped land (APN 44934202)

3.                     Approve Assignment of Purchase and Sale Agreement for the amount of $125,000 from the Fresno Housing Authority for 0.84 acres of undeveloped land (APN 44932118).

RECOMMENDATION

 

Staff recommends the City Council approve three Assignments of Purchase and Sale Agreements from the Fresno Housing Authority, in the respective amounts of $192,000 for approximately 1.03 acres, APNs 44934203, 04, and 05; $69,000 for approximately 0.28 acres, APN 44934202; and $125,000 for approximately 0.84 acres, APN 44932118; and authorize the City Manager, or her designee, to sign all documents necessary to complete the subject transactions.

 

 

EXECUTIVE SUMMARY

 

Approval of the recommended actions include approximate combined total of 2.11 acres of undeveloped land for future affordable housing projects as part of the redevelopment of Parkway Drive. Sufficient funds for the recommended actions were allocated from the American Rescue Plan Act (ARPA) and included in the Fiscal Year 2023 City Budget. The City Attorney has reviewed and approved the underlying agreements and Assignments of the Purchase and Sale Agreements to form.

 

 

BACKGROUND

 

The proposed Assignments of Purchase and Sale Agreements are respectively, 1.03 acres, 0.28 acres, and 0.84 acres in size. Fresno Housing Authority (“Housing Authority”) staff located the properties, had them appraised, inspected, and negotiated the acquisitions of the properties. Monetary consideration for the respective property acquisitions by Assignment include the purchase price of the property, and reimbursement to the Housing Authority for the appraisal cost, initial environmental inspection, and the initial deposit to open escrow. The Assignments of Purchase and Sale Agreements (“Assignments”) will be purchased with ARPA funding allocated in the fiscal year 2023 City Budget. Two of the three Assignment properties, APNs 44934203, 04, and 05, (1.03 acres) and APN 44934202 (0.28 acres) are adjacent, and if merged will measure approximately 1.31 acres in size. The third property, (0.84 acres), APN 44932118, is sufficient in size for a separate affordable housing project. While the land is sufficient size for individual affordable housing developments, staff intend to include this in the larger redevelopment plan for Parkway Drive. The City Attorney has reviewed and approved to form, the Assignments and underlying Housing Authority Purchase and Sale Agreements (“Housing Authority PSAs”).

 

Staff will discuss this item at the City Council CDBG Subcommittee on December 12, 2022.

 

 

ENVIRONMENTAL FINDINGS

 

Pursuant to §15378(b)(4) of CEQA, government fiscal activities which do not involve any commitment to any specific project which may result in a potentially significant physical impact on the environment are not considered “Projects”. The Assignments of Real Estate Purchase Agreements from the Fresno Housing Authority are speculative acquisitions for future affordable housing. The acquisitions do not involve a commitment to a specific project, and therefore do not constitute a “Project.” 

 

 

LOCAL PREFERENCE

 

Local preference is not applicable due to federal funding.

 

 

FISCAL IMPACT

 

The City’s General Fund is not impacted as a result of the recommended actions.
