Approve a Cooperative Purchase Agreement with Shade Structures, Inc. dba USA SHADE & Fabric Structures, Inc. of Dallas, TX in the amount of $297,750.59 to supply and install new cloth fabric shades for the Woodward Park Amphitheater Shade Structure project (Council District 6).

RECOMMENDATION
Staff is recommending approval of the Cooperative Purchase Agreement with Shade Structures, Inc. dba USA SHADE & Fabric Structures, Inc. of Dallas, TX in the amount of $297,750.59 under the National Joint Powers Alliance (NJPA) March 2, 2017, Request for Proposal for the procurement of Recreational and Playground Equipment, Accessories and Supplies, and authorize the Public Works Director or designee to sign the contract on behalf of the City.
EXECUTIVE SUMMARY
The Public Works Department is requesting Council approve the Cooperative Purchase Agreement to allow procurement of the fabric shades utilizing the original vendor which is both cost effective and time efficient. The vendor possesses the original plans on file which will allow the start of the fabrication process upon contract issuance. The approval will streamline the project by omitting the lengthy Request for Qualifications / Proposals, re-creating shop drawings, review periods and unknown factors of a new vendor unfamiliar with the structure. The cloth fabric shades are over five years past their life expectancy and are failing. The project is part of the adopted City budget.
BACKGROUND
The Woodward Park Amphitheater Shade Structure was constructed in 2008. The life expectancy of the cloth fabric was rated at a minimum of eight years. The cloth fabric is over five years post minimum life expectancy and needs replacement.
The Cooperative Purchase Agreement (CPA) allows the City to piggyback off certain contracts that have already gone through a competitive bidding process. This allows the City to use their pricing and not go through the traditional Request for Qualifications / Proposals. CPA’s are done for purchases with Products and Services with the majority of the spend being the Product portion of the purchase. The Product portion for this project represents seventy percent of the purchase and complies with current AO 6-28 Guidelines.
ENVIRONMENTAL FINDINGS
Pursuant to California Environmental Quality Act (CEQA) Guidelines Section 15378, this item is not a project for the purposes of CEQA because it is an administrative action that will not result in direct or indirect changes to the environment.
LOCAL PREFERENCE
Local preference was not implemented because this item will be procured through a cooperative purchase agreement.
FISCAL IMPACT
Funding for Woodward Amphitheater Shade Structure in the amount of $297,750.59 is available through the FY2022 adopted budget for the PARCS Department.
