RECOMMENDATION
Staff recommends City Council approve Phase One of a Progressive Design-Build Contract (Contract) with Bomel Construction Company Inc., of Irvine, California, to provide design support services related to the H Street Parking Structure Project (Project) in an amount not to exceed $2,216,649.00 with a contingency of $220,000.00, and authorize the Capital Projects Director or designee to execute a final Contract on behalf of the City of Fresno (City).
EXECUTIVE SUMMARY
In May 2024, Council approved the use of a Design-Build project delivery method for the H Street Parking Structure Project. Staff issued a Request for Qualifications (RFQ) to develop the Project and received five responsible and responsive Statements of Qualifications (SOQ). Based on the evaluation completed by a selections panel, staff recommend approving a Progressive Design-Build agreement with Bomel Construction Company, Inc. (Consultant), for the design of the approximate 900 stall parking structure located at APN 46704020S within Downtown Fresno.
The Capital Projects Department (CPD) and Consultant shall work collaboratively along with all stakeholders, to design the H Street Parking Structure in accordance with the Project’s scope and budget. The Project’s delivery method takes advantage of the Design-Builder’s expertise during all stages of design, funding, and construction, and provides a high degree of cost and schedule certainty. Council approval of Phase One of a Progressive Design-Build Contract is required in order for the design of the H Street Parking Structure Project to commence. The Progressive Design-Build Contract is funded through fiscal year (FY) 2024 appropriations from the Governor’s Office of Business and Economic Development (GO-Biz) grant.
BACKGROUND
The H Street Parking Structure Project includes the design and construction of an approximate 900 stall parking structure located at APN 46704020S within the City of Fresno’s downtown area. The Project will be designed as a multi-level facility which will provide a central location with ample parking spaces for all commuters, visitors and residents, ensuring easy access to the vibrant shops, restaurants, and cultural attractions that define the City. The Project will provide opportunities to enhance the community by serving as a key infrastructure component amidst a mixed-use design. Development of the structure integrates technology for electric vehicle charging and promotes carpooling to nearby events. By providing a designated location for vehicles, the surrounding locations can be further improved for more pedestrian-friendly environments, parks, or bike lanes. Thus, enhancing the overall appeal of the area and serving as a catalyst for community enhancement in the downtown area.
On May 23, 2024, Council approved the use of Fresno Municipal Code Section 4-502(d), Design-Build Qualification Method of procurement for the project. Through a competitive Progressive Design Build procurement process, CPD advertised a Request for Qualifications (RFQ) on December 18, 2024, via Planet Bids and direct email to prospective design-build teams with the capability and experience necessary to execute the H Street Parking Structure Project. Five design-build teams responded to the RFQ. Their qualifications were evaluated and rated by a committee of five in accordance with the provisions of the RFQ, and an interview was conducted with all five of the design-build teams. The evaluation committee consisted of staff representing different City departments, including Capital Projects, Planning and Development, and the Mayor’s Office. Bomel Construction, based in Irvine, California, and their team, including Choate Parking Consultants (CPC), Culp & Tanner, Inc., Salas O’Brien, and Provost & Pritchard, was determined to be the most qualified team to collaboratively work with the City and provide the best opportunity to meet the Project goals and required outcome.
Staff recommends City Council approve the proposed Progressive Design-Build contract with Bomel Construction Company Inc., in an amount not to exceed $2,216,649.00 with a contingency amount of $220,000.00, for design support services and the preparation of construction documents for the H Street Parking Structure Project and authorize the Capital Projects Interim Director or designee to execute the final Contract on behalf of the City.
The Progressive Design Build Contract utilizes a modified Design-Build Institute of American (DBIA) standard Progressive Design-Build Agreement which has been reviewed and approved by the City Attorney’s Office as to form.
Planned future actions associated with the H Street Parking Structure Project include executing Phase Two (construction) of the Progressive Design-Build contract.
ENVIRONMENTAL FINDINGS
Pursuant to California Environmental Quality Act (CEQA) Guidelines Section 15378, this is not a “project’ as defined by CEQA.
LOCAL PREFERENCE
Bomel Construction Company, Inc. is not considered a local business as defined by the Fresno Municipal Code, however one of their design subconsultants would be considered a local business.
FISCAL IMPACT
The proposed project is in Council District 3. The Progressive Design-Build Contract is funded through FY2024 appropriations from the Governor’s Office of Business and Economic Development (GO-Biz) and will have no impact to the General Fund.
