RECOMMENDATIONS

 

Staff recommends that Council  approve an extension of the agreement with The Gordian Group through December 31, 2020; approve an extension of the contract with Puma Construction through December 31, 2020 and, award a construction contract with Puma Construction for $2,418,252.

 

EXECUTIVE SUMMARY

 

On August 27, 2015, Council approved an agreement with The Gordian Group, Inc. for the implementation of the Job Order Contracting (JOC) program. This agreement expires on August 27, 2020. On September 28, 2017, Council awarded a JOC contract to Puma Construction. This contract expires on September 28, 2020. In an effort to minimize the spread of COVID-19, the City wishes to use CARES Act funding to retrofit all faucets, soap dispensers, toilets, urinals, paper towel dispensers and water fountains in City buildings with touchless.  With CARES Act funding expiring December 31st, it is necessary to use the JOC program to expedite the retrofits and incur expenses before the December 31st deadline. Staff recommends that Council approve an extension of the agreement with The Gordian Group through December 31, 2020, approve an extension of the contract with Puma Construction through December 31, 2020 and award the construction contract with Puma Construction for $2,418,252.

 

BACKGROUND

 

In light of the COVID-19 global pandemic, and in an attempt to minimize the spread of the Coronavirus, the City wishes to install touchless plumbing fixtures, as well as soap and paper towel dispensers using the CARES Act funding.

 

On August 27, 2015, Council approved an agreement with The Gordian Group, Inc. for the implementation of the JOC program, which expires on August 27, 2020. On September 28, 2017, Council awarded a contract with Puma Construction for JOC projects, which expires on September 28, 2020. While the City is currently in the middle of the processes to enter into a new agreement with The Gordian Group and awarding new contracts for the JOC program, it is crucial that we begin the retrofit project immediately to ensure it is completed by the December 31, 2020 CARES Act deadline.

 

Staff recommends that Council approve the extension of the agreement with The Gordian Group through December 31, 2020, approve the extension of the contract with Puma Construction through December 31, 2020 and award a construction contract to Puma Construction for $2,418.252,

 

ENVIRONMENTAL FINDINGS

 

 Staff has determined that a Categorical Exemption is appropriate, based on Class 1 Section 15301(d) of the California Environmental Quality Act (CEQA) Guidelines, which exempts restoration or rehabilitation of deteriorated or damaged structures, facilities or mechanical equipment to meet current standards of public health and safety.  Furthermore, staff has determined that none of the exceptions to Categorical Exemptions set forth in the CEQA Guidelines, Section 15300.2 apply to this project.  Staff recommends that the Council, based upon its own independent judgment, adopt a finding of a Categorical Exemption per Staff determination, pursuant to Section 15301(d), Class 1 of the CEQA Guidelines for the work intended under the JOC program. No new facilities will; be bid under this program. Only facility rehabilitation projects will be using the JOC program.

 

LOCAL PREFERENCE

 

Local preference was not implemented; this is an amendment to an existing agreement.

 

FISCAL IMPACT

 

This is a CARES Act eligible project.
