RECOMMENDATION

 

Staff recommends the City Council approve a Sixth Amendment to the Consultant Services Agreement with Blair, Church & Flynn, Consulting Engineers, Inc., of Clovis, California, in the amount of $368,200.00. This amendment provides additional civil engineering design services and prepares construction documents necessary to update the engineering design and prepare bid packages, as well as to provide support services for the bidding and construction efforts for Phase II (Florence Avenue to Church Avenue) and Phase III (Church Avenue to Jensen Avenue) of the Peach Avenue Widening Project. Staff further recommends authorizing the Capital Projects Director or designee to sign the Sixth Amendment on behalf of the City of Fresno (City).

 

EXECUTIVE SUMMARY

 

The City of Fresno seeks to continue engineering design work for Phase II (Florence Avenue to Church Avenue) and Phase III (Church Avenue to Jensen Avenue) of the Peach Avenue Widening Project. To facilitate this work, the City proposes to amend the original Consultant Services Agreement with Blair, Church & Flynn, Consulting Engineers, Inc., of Clovis, California, to complete the final engineering design, prepare bid documents, and provide bidding and construction support services for the two outstanding phases of roadway work. Staff recommends approval of this Sixth Amendment in the amount of $368,200.00, bringing the total contract amount to $720,124.00. The project is fully funded by Regional Measure C Tier 1 funding and local developer impact fees.

 

BACKGROUND

 

The City entered into a consultant agreement with Blair, Church & Flynn, Consulting Engineers, Inc., (BCF) of Clovis, California, on February 21, 2013, to provide civil engineering design services and preparation of construction documents for the Peach Avenue Widening Project between Butler and Jensen Avenues. The Project is funded by Measure “C” and local developer impact fees. On December 11, 2013, the Agreement was amended in the amount of $13,400 (First Amendment) to provide additional design services for the addition of a new traffic signal at Peach and Hamilton Avenues. 

 

The Agreement was amended again on July 13, 2014, in the amount of $26,300 (Second Amendment) to split the project into two phases. Phase I consists of Butler Avenue to Florence Avenue widening and Phase II consists of Florence Avenue to Jensen Avenue. The Second Amendment was to provide two separate sets of construction plans, specifications, and estimates. The engineering design of the Project was 90% complete and the Project was divided once more due to funding availability. The second phase of the Project has since been divided into Phase II (Florence Avenue to Church Avenue) and Phase III (Church Avenue to Jensen Avenue). Staff now intends to continue the design of Phase II and Phase III of the Project. The design for Phase I has since been completed and is currently in construction.

 

The Agreement was further amended on September 19, 2018 (Third Amendment), to revise and update the September 2014 CEQA Initial Study. The scope and fees for Parts 4 and 5 of the agreement were removed to reallocate funds for the Third Amendment. The Third Amendment was a total net change of $0 to the Agreement.

 

The Agreement was amended again on February 28, 2020, in the amount of $32,462 (Fourth Amendment) to complete the final construction documents and provide bidding and construction support services for Phase I of the Project. This amendment included updating the consultant’s billing rates due to delays in the project, addressing design revisions and replenished funding that was reallocated with the Third Amendment for Part 4 (Bidding Support) and Part 5 (Construction Support) for Phase I of the Project.

 

The Agreement was amended again on January 26, 2023, in the amount of $24,962 (Fifth Amendment) to allow for the revision to the plans to accommodate access to the proposed South Peach Avenue Park Project, including bidding and construction support services, for Phase I of the Project.

 

The City now desires to amend the Agreement with BC&F in the amount of $368,200, to complete the final construction documents and provide additional bidding and construction support services for Phase II and Phase III of the Peach Avenue Widening Project. The Sixth Amendment will be funded with Regional Measure C Tier 1 funding and developer impact fees.

 

The City Attorney’s Office has reviewed and approved the amendment as to form.

 

ENVIRONMENTAL FINDINGS

 

By the definition provided in the California Environmental Quality Act (CEQA) Guidelines Section 15378 the contract amendment does not qualify as a project as defined by the CEQA.

 

LOCAL PREFERENCE

 

Local preference does not apply, as this amendment amends an existing agreement.

 

FISCAL IMPACT

 

This project is located in Council District 5 and will have no impact on the General Fund. The Project is fully funded by Regional Measure C Tier 1 funding and developer impact fees, with appropriations for this amendment included in the current fiscal year budget as adopted by the City Council.
