RECOMMENDATION

 

It is recommended that Council adopt the Twelfth Amendment to the Fiscal Year 2025 Salary Resolution No. 2024-120 to add the new classification of Right of Way Agent and the respective salary step plan range in Exhibit 3, Unit 3, Non-Supervisory White Collar (FCEA), effective February 24, 2025; amend Exhibit 13-1, Unit 13, Exempt Supervisory and Professional (CFPEA) to add the new classification of Senior Right of Way Agent and the respective monthly salary step plan range, effective February 24, 2025; and amend Exhibit 14, Management Classes (CFMEA) to add the new classification of Right of Way Agent Manager and the respective monthly salary step plan range, effective February 24, 2025.

 

EXECUTIVE SUMMARY

 

The Capital Projects Department has a need to establish a classification series focused on establishing values of and negotiating with land property owners for City right of way and utility purposes and the disposition of City owned real property pursuant to the Surplus Land Act along with presenting information on right of way activities to the public and in public forums.  The following new classifications are recommended:

 

                     Exhibit 3, Unit 3, Non-Supervisory White Collar (FCEA)

§                     Right of Way Agent monthly salary will be set at Step A - Step E: $7,331 - $8,911.

                     Exhibit 13, Unit 13,  Exempt Supervisory and Professional (CFPEA)

§                     Senior Right of Way Agent monthly salary will be set at Step A - Step E: $8,612 - $10,469.

                     Exhibit 14, Management Classes (CFMEA)

§                     Right of Way Agent Manager monthly salary will be set at Step A - Step I: $9,545 - $11,633.

 

These actions will not require additional appropriations by the department. The City has provided notice to the respective bargaining units and has met its meet and confer obligation.

 

BACKGROUND

 

In collaboration with the Capital Projects Department, Personnel Services recommends the establishment of the Right of Way Agent classification series.  This series will be focused on establishing values of and negotiating with land property owners for City right of way and utility purposes and the disposition of City owned real property pursuant to the Surplus Land Act.  Responsibilities include conducting research on property history including title research, waiver evaluations, eminent domain procedures, assisting with relocation assistance to eligible property owners and/or tenants/occupants, preparing legal documents related to the valuation, acquisition, and disposition, and valuation of real property and property rights, presenting real property acquisition and disposition updates to management staff, their Supervisor and/or Manager, Council members, and in public forums.

 

The creation of these new classifications will assist with recruitment and retention efforts in these highly competitive classifications.  The new classifications are recommended as follows:

 

Exhibit 3, Unit 3, Non-Supervisory White Collar (FCEA)

 

                     Right of Way Agent monthly salary will be set at Step A - Step E: $7,331 - $8,911.

 

Exhibit 13, Unit 13,  Exempt Supervisory and Professional (CFPEA)

 

                     Senior Right of Way Agent monthly salary will be set at Step A - Step E: $8,612 - $10,469.

 

Exhibit 14, Management Classes (CFMEA)

 

                     Right of Way Agent Manager monthly salary will be set at Step A - Step I: $9,545 - $11,633.

 

The City provided notice to the respective bargaining units and has met its meet and confer obligation.

 

The City Attorney’s Office has approved the Twelfth Amendment to Salary Resolution No. 2024-120 as to form.

 

ENVIRONMENTAL FINDINGS

 

By the definition provided in the California Environmental Quality Act Guidelines Section 15378 this item does not qualify as a “project” and is therefore exempt from the California Environmental Quality Act requirements.

 

LOCAL PREFERENCE

 

Local preference is not implicated because this item does not involve public contracting or bidding with the City of Fresno.

 

FISCAL IMPACT

 

The amendments will not require any additional appropriations for Fiscal Year 2025.
