RECOMMENDATION
 
Authorize the City Manager to execute an agreement with Ovations FanFare, L.P. ("Ovations"), subject to City Attorney approval, to sell the portable stage located at Chukchansi Park for $25,000.
 
EXECUTIVE SUMMARY
 
Ovations has expressed an interest in purchasing the portable stage, currently located at Chukchansi Park, which will be refurbished and subsequently used by Ovations at the Cal Expo site located in Sacramento.  The stage is approximately 14 years old and has never been used as originally envisioned due to liability issues and the fact that when there are concerts held at the Stadium entertainment groups include their own stage.  The tentative sale price for the stage is $25,000 and is being sold "as is."
 
BACKGROUND
 
The City has recently been approached by Ovations regarding the possible sale of the portable stage located at Chukchansi Park.  It is Ovations' intent to refurbish the stage and relocate it to the Cal Expo site located in Sacramento, CA. Ovations is responsible for the cost of dismantling, transporting and refurbishing the stage.   
 
The portable stage was originally intended to be used for concerts and other events that would be held at Chukchansi Park.  Unfortunately very few events requiring the use of the portable stage have ever been held at the stadium, and those that did occur, provided their own stage.  The stage is approximately 14 years old and while never utilized, is in need of refurbishment.  The proposed sale price is $25,000 and is being sold "as is," which means the City would be released from all liabilities associated with the future use of the stage.
 
ENVIRONMENTAL FINDINGS
 
By the definition provided in the California Environmental Quality Act ("CEQA") Guidelines section 15378 this item does not qualify and is therefore exempt from the CEQA requirements.
 
LOCAL PREFERENCE
 
Local preference does not apply.
 
FISCAL IMPACT
 
The $25,000 derived from the sale of the stage would be used to fund future capital repairs at Chukchansi Stadium.
