RECOMMENDATION

 

Staff recommends the City Council ratify and approve the terms of the Fifth Amendment to the Agreement entered between the City of Fresno and the Central California Society for the Prevention of Cruelty to Animals (CCSPCA) for a six-month extension of the Agreement in the amount not to exceed $2,898,498 and authorize the City Manager to execute subject to City Attorney approval.   

 

EXECUTIVE SUMMARY

 

The CCSPCA provides the City of Fresno (City) with all animal control, pound master, veterinary and animal sheltering services, and facilities pursuant to a contract entered in March 2014 and effective through December 31, 2021. The proposed Fifth Amendment will allow the CCSPCA to continue to provide services through June 30, 2022, which will provide the City with time to complete the new animal shelter, award a contract to the new animal service provider pursuant to the City’s Request for Qualifications (RFQ) and transfer or otherwise relocate animals from the CCSPCA.  The City Council previously approved funding to over services through June 30, 2022, as part of the FY2022 budget process.  However, the Administration just became aware that the 4th Amendment had no additional extensions available, and a 5th Amendment would be necessary to provide the necessary authority to execute payment through June 30, 2022.

 

BACKGROUND

 

The CCSPCA has been providing the City with animal control services, including animal control, pound master, veterinary and animal sheltering services, since March 2014 pursuant to the current agreement, which expired on December 31, 2021.  The proposed Fifth Amendment will grant a six-month extension of the Agreement and allow the CCSPCA to continue administering animal control services while providing the City with time to complete the new animal shelter, award a contract to the new animal service provider pursuant to the City’s RFQ, and transfer or otherwise relocate animals from the CCSPCA.  

 

In addition to extending the Agreement’s termination date to June 30, 2022, the proposed Fifth Amendment:  

                     Increases the annual budget of $5,345,000 by $226,000 for wage increases and pricing inflation factors for a total amount not to exceed $2,898,498; and  

                     Allows for up to three, thirty-day extensions to allow the City to extend services if necessary to complete the animal shelter, finalize an award of a service provider contract or transfer animals from the CCSPCA.  

 

ENVIRONMENTAL FINDINGS

 

This is not a project under California Environmental Quality Act (CEQA) pursuant to CEQA Guidelines Section 15378. 

 

LOCAL PREFERENCE

 

Local preference does not apply because this is an amendment to an existing agreement. 

 

FISCAL IMPACT

 

The FY 2022 Adopted Budget approved by Council includes funding for this contract which will be paid for by the General Fund.
