RECOMMENDATIONS

 

Staff recommends that Council (1) adopt a finding of Categorical Exemption per staff’s determination, pursuant to Section 15303/Class 3 of the California Environmental Quality Act (CEQA) Guidelines, Environmental Assessment No. PC00346, (2) award a construction contract in the amount not to exceed of $608,363.20 to American Paving Co. of Fresno, California, as the lowest responsive and responsible bidder for the Large Park Restroom Project (Project), and authorize the Capital Projects Director or designee to sign the standardized construction contract on behalf of the City of Fresno (City).

 

EXECUTIVE SUMMARY

 

The Capital Projects Department seeks to award a construction contract to American Paving Co. following a competitive bidding process which identified them as the lowest responsive and responsible bidder in the amount of $608,363.20. The Project will improve accessibility and safety for park guests by providing a new prefabricated restroom building that is fully compliant with Americans with Disabilities Act (ADA) requirements. The new restroom building will have four separate stalls, two of which will be ADA compliant. The construction contract will be funded utilizing Fiscal Year (FY) 2026 appropriations from Measure P, Expenditure Category 1.

 

BACKGROUND

 

Large Park is a 6.5-acre park located at 4424 North Millbrook Avenue adjacent to Thomas Elementary School.  The park contains a large field used primarily for soccer and is quite busy on weekends and holidays, however, the park does not contain a restroom facility.  The Parks, After School, Recreation and Community Services (PARCS) Department wishes to better serve guests of Large Park by installing a new prefabricated restroom building to enhance the park’s role as a welcoming space for all visitors and support public health.  This requires bringing sewer services and additional water services to the site, as well as providing an accessible pathway from the existing sidewalk to the new restroom building. 

 

On July 20, 2023, Council approved an On-Call Consultant Services Agreement with GHD, Inc. for architectural and engineering design services on Fresno parks capital improvement projects (Citywide). On January 18, 2024, the Capital Projects Department approved a Task Order with GHD, Inc. for the design and preparation of construction documents for the Project.

 

A Notice Inviting Bids was published in Planet Bids and posted on the City’s website on October 28, 2025.  The Project plans and specifications were distributed to forty-six (46) prospective bidders and posted at three (3) building exchanges. Six (6) electronic bids were received and opened in a public bid opening on December 2, 2025, with bid amounts ranging from $544,361.55 to $774,420.50.  After the four apparent lowest bidders were determined to be non-responsive due to either missing documents or listing subcontractors with expired DIR registrations, American Paving Co. was determined to be the lowest responsive and responsible bidder in the amount of $608,363.20. The bids will expire on February 4, 2026. If the bids are rejected or expire, the project must be rebid which will result in a delay to the Project.

 

The Community Workforce Agreement, also known as Project Labor Agreement (PLA), adopted by Council in September 2021, does not apply to this contract because the engineer’s estimate for this project was less than $1 million, pursuant to the terms of the PLA.

 

Staff recommends Council adopt a finding of a Categorical Exemption per staff’s determination, pursuant to Section 15303/Class 3 of the CEQA Guidelines, Environmental Assessment No. PC00346,  award a construction contract to American Paving Co. of Fresno, California, in the amount of $608,363.20, as the lowest responsive and responsible bidder for the Large Park Restroom Project, and authorize the Capital Projects Director or designee to sign the standardized construction contract on behalf of the City of Fresno. The Large Park Restroom Project will be funded utilizing Measure P, Expenditure Category 1 Funds.

 

The City Attorney’s Office has reviewed and approved the standardized construction contract as to form.

 

ENVIRONMENTAL FINDINGS

 

Staff has determined that a CEQA Guidelines Section 15303/Class 3 (New Construction or Conversion of Small Structures) Categorical Exemption is appropriate, which consists of construction and location of limited numbers of new, small facilities or structures, because the Project proposes construction of a new, small restroom facility and associated infrastructure tie-ins and an accessible pathway connected to Millbrook Avenue. 

 

Furthermore, staff has determined that none of the exceptions to Categorical Exemptions set forth in the CEQA Guidelines, Section 15300.2 apply to this Project.  Staff recommends that Council, based upon its own independent judgment, adopt the finding of a Categorical Exemption per Staff determination, pursuant to Section 15303, Class 3 of the CEQA Guidelines for the Large Park Restroom Project.

 

LOCAL PREFERENCE

 

American Paving Co. is a local business, as defined by the Fresno Municipal Code.

 

FISCAL IMPACT

 

The Large Park Restroom Project is in Council District 4 and will have no impact to the General Fund.  The Project will be funded utilizing Measure P, Expenditure Category 1 Funds.
