RESOLUTION - Authorizing submittal of Used Oil Payment Program grant applications and authorizations related to the administration of California Department of Resources Recycling and Recovery (CalRecycle), Used Oil Payment Program (Citywide)

RECOMMENDATION

 

It is recommended that the City Council adopt a Resolution to authorize the submittal of grant applications and acceptance of Used Oil Payment Program funding under the California Oil Recycling Enhancement Act administered by the Department of Resources Recycling and Recovery (CalRecycle).

 

EXECUTIVE SUMMARY

 

The adoption of the above Resolution will ensure the implementation and execution of the City of Fresno’s grant funded Used Motor Oil and Filter Recycling Program continue on schedule. This action will provide for a continuum of the Used Motor Oil and Filter Recycling Program activities to include community education and outreach, residential curbside collection of used motor oil/filters and media promotion and that funding expenditures are applied consistent with State requirements. The term of the Resolution is from July 1, 2015 through June 30, 2020.  This Resolution supersedes Resolution No. 2010-107 dated May 12, 2010 (Expires: June 30, 2015).

 

BACKGROUND

 

The California Public Resources Code §48600 et seq. describes the California Oil Recycling Enhancement Act, which provides up to $11 million annually in payments to local governments for implementation of local used oil and filter collection programs.  The Used Oil Payment Program (OPP) authorized in Senate Bill 546 (Lowenthal, Chapter 353, Statutes of 2009) replaces the Used Oil Block Grant Program (UBG).  While the purpose of the OPP is similar to the UBG, there are significant differences regarding the application, administration, and reporting requirements.  CalRecycle is responsible for administering the OPP.

 

The City’s Solid Waste Management Division has taken advantage of the State of California’s used oil block grants since 1994.  The City has been awarded on average $142,965 annually over the lasts three years.  Grant funds are used each year to promote the importance of recycling used motor oil and to support community outreach and public education.  In FY14, Solid Waste residential curbside collection program recycled 12,135 gallons of used motor oil and 6,750 filters, attended 28 community outreach events and 109 school recycling education presentations.

 

In May of 2015, CalRecycle released notification of funding availability. The adoption of the above Resolution will ensure the implementation and execution of the City of Fresno’s grant funded Used Motor Oil and Filter Recycling Program continue on schedule.

 

ENVIRONMENTAL FINDINGS

 

By the definition provided in the California Environmental Quality Act Guidelines Section 15378 this item does not qualify as a “project” for the purposes of the California Environmental Quality Act.

 

LOCAL PREFERENCE

 

Local preference was not implemented because the adoption of a resolution does not include a bid or an award of a construction or services contract.

 

FISCAL IMPACT

 

There will be no fiscal impact to the General Fund or any City operating funds associated with the recommended action. This project will benefit all Council districts.
