Staff recommends Council authorize the City Manager or Designee to enter into an MOU with the Red Cross and any related Facility Use Agreements for emergency readiness and response activities include warming center operations.
EXECUTIVE SUMMARY
The City of Fresno (City) is pursuing an MOU and Facility Use Agreements with the Red Cross to enable emergency readiness and response activities to occur at City community center facilities. The MOU will define a working relationship between the City and the Red Cross, and the Facility Use Agreements will further specify contact information and the terms and conditions for facility use. The City initially intends to enter into Facility Use Agreements at Maxie L. Parks Community Center, Mosqueda Community Center, Pinedale Community Center and Ted C. Wills Community Center. The resolution also provides authority for the City Manager or designee to administratively extend the MOU for one, two-year period and enter into additional Facility Agreements as needed. The current designee for contract execution is the PARCS Director.
BACKGROUND
On September 29, 2022, the Fresno City Council passed a resolution establishing a policy for City cooling and warming centers. The policy provided direction on activation temperatures, operating hours, locations, transportation, and other accommodations. To help fulfill responsibilities under that resolution, the City is requesting authority to enter into an MOU and Facility Use Agreements with the Red Cross to support emergency preparedness and response activities, including activation of warming centers.
The Red Cross provides disaster cycle services pursuant to its Congressional Charter (USC 36 §§300101-300111). In the Charter, Congress authorized the Red Cross to carry out a system of national and international relief in time of peace and apply that system in mitigating the suffering caused by pestilence, famine, fire, floods, and other great national calamities, and to devise and carry out measures for preventing those calamities.
On December 14, 1988, the City of Fresno entered into an Agreement with the Fresno-Madera Chapter of the American National Red Cross concerning the use of City of Fresno Community Center Facilities as Mass Shelters. In May 2019, the City of Fresno entered Facility Use Agreements with the Red Cross for use of facilities at Ted C. Wills and Moqueda Community Center. The City now wishes to replace the 1988 Agreement with a Memorandum of Understanding to further define the working relationship between the American Red Cross and the City and enter into revised Facility Use Agreements to update insurance and indemnity language.
The MOU is for an initial term of three (3) years, with an option for one two (2) year extension. The MOU outlines the services Red Cross will provide to help prepare, respond, and recover from disasters. The MOU also outlines cooperative actions between the Red Cross and the City of Fresno, including, but not limited to, providing support as part of warming center operations. Facility Use Agreements will enable Red Cross to utilize Community Center facilities to provide services, store related supplies, park vehicles and provide disaster shelter. Consistent with the adopted policy, the City initially intends to enter into Facility Use Agreements at Maxie L. Parks Community Center, Mosqueda Community Center, Pinedale Community Center and Ted C. Wills Community Center. The resolution also provides authority for the City Manager or designee to enter into additional Facility Agreements as needed. The current designee for contract execution is the PARCS Director.
City Attorney has reviewed and approved as to form.
ENVIRONMENTAL FINDINGS
An MOU and Facility Use Agreements are not a project pursuant to section 15378 of the California Environmental Quality Act.
LOCAL PREFERENCE
Local preference is not applicable.
FISCAL IMPACT
The MOU and Facility Use Agreements will have no impact on the general fund.
