Actions pertaining to California Tupman and Romain Park Improvements Project (Bid File No. 12500042) (Council Districts 3 and 7):

1.                     Adopt a finding of Categorical Exemption per staff’s determination, pursuant to Section 15301/Class 1 and Section 15302/Class 2 of the California Environmental Quality Act Guidelines, Environmental Assessment No. PC00326 and PC00319, for the California Tupman and Romain Park Improvements Project;

2.                     Award a construction contract in the amount of $434,056.02 to Geometric Construction Inc., of Fresno, California, as the lowest responsive and responsible bidder for the California Tupman and Romain Park Improvements Project.

RECOMMENDATIONS

 

Staff recommends that the City Council (1) adopt a finding of Categorical Exemption per staff’s determination, pursuant to Section 15301/Class 1 and 15302/Class 2 of the California Environmental Quality Act (CEQA) Guidelines, Environmental Assessment No. PC00326 and PC00319 and (2) award a construction contract to Geometric Construction Inc., of Fresno, California, in the amount of $434,056.02 as the lowest responsive and responsible bidder for the California Tupman and Romain Park Improvements Project (Project), and authorize the Capital Projects Director or designee to sign the standardized construction contract on behalf of the City of Fresno (City).

 

EXECUTIVE SUMMARY

 

The Capital Projects Department seeks to award a construction contract to Geometric Construction Inc. following a competitive bidding process which identified them as the lowest responsive and responsible bidder in the amount of $434,056.02. The Project will improve the play structure areas at California Tupman Park and Romain Park to enhance the park guest experience, safety, and accessibility. The scope of work at California Tupman Park includes the replacement of three picnic tables with one meeting ADA compliance and the installation of a shade structure over the existing merry-go-round and swing set. The scope of work at Romain Park includes replacing the existing mulch surfacing with pour-in-place soft-fall safety surfacing, ADA compliant deepened concrete playground curb and concrete edge and installation of two waste receptacles on concrete pads along the path of travel. The construction contract will be funded using Fiscal Year (FY) 2025 appropriations from Measure P.

 

BACKGROUND

 

California Tupman Park is located on the northeast corner of Ceasar Chavez Boulevard and Tupman Avenue, and Romain Park is located on the southeast corner of Thomas Avenue and First Street. The design was initiated though a consultant agreement with O’Dell Engineering Inc., on May 3, 2023, for the design and preparation of construction documents for the Project. California Tupman Park improvements include the replacement of three picnic tables with one meeting ADA compliance, temporary Measure P signage, and installation of a shade structure over the existing merry-go-round and swing set. The Romain Park improvements include replacing the existing mulch surfacing with pour-in-place soft-fall safety surfacing, ADA compliant deepened concrete playground curb and concrete edge, temporary Measure P signage, and installation of two waste receptacles on concrete pads along the path of travel.

 

A Notice Inviting Bids was advertised and published in the Business Journal, Planet Bids, and posted on the City’s website on July 19, 2024. The Project plans and specifications were distributed to 49 prospective bidders and posted at six (6) building exchanges. One (1) sealed bid proposal was received and opened in a public bid opening on August 20, 2024, with a bid amount of $434,056.02. Geometric Construction Inc. was determined to be the lowest responsive and responsible bidder. Only one bid was received and may be due to other PARCS projects that were due to open bids on the same day.  The bids will expire on October 23, 2024. If the bids are rejected or expire, the Project must be rebid which will result in a delay to the Project.

 

The Community Workforce Agreement (PLA), adopted by Council in September 2021, does not apply to this contract because the engineer’s estimate for this project was less than $1 million, pursuant to the terms of the PLA.

 

Staff recommends Council adopt a finding of Categorical Exemption per staff’s determination, pursuant to Section 15301/Class 1 and 15302/Class 2 of the California Environmental Quality Act Guidelines, Environmental Assessment No. PC00326 and PC00319 and award a construction contract to Geometric Construction Inc., in the amount of $434,056.02, as the lowest responsive and responsible bidder for the California Tupman and Romain Park Improvements Project, and authorize the Capital Projects Director or designee to sign and execute the standardized construction contract on behalf of the City of Fresno. The construction contract will be funded using FY 2025 appropriations from Measure P.

 

The City Attorney’s Office has reviewed and approved the contract documents as to form.

 

ENVIRONMENTAL FINDINGS

 

Staff performed a preliminary environmental assessment of this Project and determined that it falls within the Categorical Exemption set forth in CEQA guidelines, Section 15301/Class 1 and Section 15302/Class 2.  Section 15301/Class 1 consists of projects that include minor alterations to existing facilities and shall replace existing structures and facilities with new structures located on the same site as the structure replaced and will have substantially the same purpose and capacity.

 

Section 15302/Class 2 consists of projects that include replacement or reconstruction of existing structures and facilities where the new structure will be located on the same site as the structure replaced and will have substantially the same purpose and capacity as the structure replaced.

 

Furthermore, staff has determined that none of the exceptions to Categorical Exemptions set for in the CEQA Guidelines, Section 15300.2 apply to this Project.  Staff recommends that Council, based upon its own independent judgment, adopt a finding of a Categorical Exemption per Staff determination, pursuant to Sections 15301/Class 1 and 15302/Class 2 of the CEQA Guidelines for the California Tupman and Romain Park Improvements Project.

 

LOCAL PREFERENCE

 

Geometric Construction, Inc. is a local business, as defined by the Fresno Municipal Code.

 

FISCAL IMPACT

 

The California Tupman and Romain Park Improvements Project is in Council Districts 3 and 7 and will have no impact to the General Fund. The Project will be funded utilizing Fiscal Year 2025 appropriations from Measure P.
