Actions pertaining to the H Street Parking Structure Project (Council District 3)
1. Adopt a finding that the project is categorically exempt from the requirements of the California Environmental Quality Act (CEQA), pursuant to Class 32/Section 15332 of the CEQA Guidelines, and that none of the exceptions to exemptions set forth in Section 15300.2 apply

RECOMMENDATION
Staff recommends the City Council (1) adopt a finding that the project is categorically exempt from the requirements of the California Environmental Quality Act (CEQA), pursuant to Class 32/Section 15332 of the CEQA Guidelines, and that none of the exceptions to exemptions set forth in Section 15300.2 apply; and (2) approve Design-Build Contract Amendment No. 2 for Phase Two of a Progressive Design-Build Agreement with Bomel Construction Company Inc. to provide design and construction services related to the H Street Parking Structure Project (Project) for an amount not to exceed $45,123,776.00, bringing the total contract amount to $47,516,755.00, and authorize the Capital Projects Director or designee to sign a final Contract on behalf of the City of Fresno.
EXECUTIVE SUMMARY
The Capital Projects Department (CPD) and Mayor’s Office have initiated and completed Phase One of the Project, which included schematic design, cost estimation, schedule development, and other preconstruction services of a 900 or more stall parking structure, located on an existing City-owned surface lot bounded by H Street, Mono Street, Union Pacific Railroad (UPRR), and the extension of Inyo Street.
CPD and the Mayor’s Office now seek to amend the Progressive Design-Build Agreement with Bomel Construction Company Inc. to initiate the Phase Two Construction Services necessary to finalize design and construct the Project. Approval of this Amendment will increase the Contract by an amount not to exceed $45,123,776.00 for a total revised contract value not to exceed $47,516,755.00. Design-Build Contract Amendment No. 2 for Phase Two of the Progressive Design-Build Agreement is funded by the Governor’s Office of Business and Economic Development (GO-Biz) Fiscal Year (FY) 26 appropriations.
BACKGROUND
On May 23 2024, Council approved the use of Fresno Municipal Code Section 4-502(d), Design-Build Qualification Method of Procurement for the Project. Through a competitive, qualifications-based procurement process, CPD advertised a Request for Qualifications (RFQ) and Bomel Construction Company Inc. was selected as the Design-Builder for the Project. On April 24, 2025, Council awarded the Phase One Preconstruction Services portion of the Progressive Design-Build Agreement to Bomel Construction Company Inc. in the amount of $2,216,649.00 and a contingency amount not to exceed $220,000.00. This approval was for the design of an approximately 900-stall parking structure intended to provide parking opportunities for area events, attractions and future housing developments in the project area.
On March 24, 2026, Design-Build Contract Amendment No. 1 to the Progressive Design-Build Agreement was executed with Bomel Construction Company Inc., increasing the design fee by $176,330.00 for a revised total contract value not to exceed $2,392,979.00. The Amendment was covered by design contingency, bringing the total contingency to an amount not to exceed $43,670.00. This design change increased the scope of work to extend to off-site improvements, design of landmark and parking signage, and conduct additional environmental studies for further investigation of the project site.
Phase One Preconstruction Services included site and area assessments, conceptual and design plan development, and cost assessment of a 900 or more stall parking structure. Phase Two Construction Services of the Progressive Design-Build Agreement includes the completion of design services, procurement of all materials and equipment, performance of construction services, start-up, testing, commissioning, and the provision of warranty services for the Project. The Phase Two portion of the contract includes a guaranteed maximum price (GMP) for construction of $45,123,776.00. Council approval of the Phase Two Construction Services portion of the Progressive Design-Build Agreement is recommended for the construction of the H Street Parking Structure Project to commence. The total contract cost, including Phase One and Phase Two of the Progressive Design-Build Agreement is not to exceed $47,516,755.00.
This contract is covered by the Community Workforce Agreement (PLA), adopted by Council in September 2021. The Contractor shall become signatory to the PLA by executing the Agreement To Be Bound.

The contract utilizes a modified Design-Build Institute of America (DBIA) standard Progressive Design-Build Agreement which has been reviewed and approved as to form by the City Attorney’s Office.
ENVIRONMENTAL FINDINGS
This project is categorically exempt from the requirements of CEQA pursuant to CEQA Guidelines Section 15332/Class 32 pertaining to infill developments because it is located on a 2.26 acre site, which is less than 5 acres, and which is substantially surrounded by urban uses; is consistent with the applicable general plan designation and zoning and does not require a plan amendment or rezone; has been determined to have no value as habitat for endangered, rare, or threatened species, as set forth in a supporting technical study; would not result in significant effects as demonstrated by a supporting technical study, and can be adequately served by all required utilities and public services.
Moreover, none of the exceptions to categorical exemptions set forth in CEQA Guidelines Section 15300.2 apply to this project.
Therefore, a finding of Class 32 Categorial Exemption is appropriate. Further details are included in the Categorical Exemption with Technical Studies, attached to the Report to Council.
LOCAL PREFERENCE
Local preference does not apply as this is an amendment to the existing contract.
FISCAL IMPACT
The H Street Parking Structure Project is in Council District 3 and will have no impact on the General Fund. The amendment is fully funded by the Governor’s Office of Business and Economic Development (GO-Biz) FY 26 appropriations.
