SUBJECT

Title

RESOLUTION - Dedicating portions of City-owned property for public utility purposes to accommodate the construction of public utilities at the H Street Parking Structure (Council District 3)

Body

RECOMMENDATION

Staff recommends that Council adopt a resolution dedicating those portions of City-owned property for public utility purposes to accommodate the construction of public utilities at the H Street Parking Structure.

EXECUTIVE SUMMARY

On May 21, 2026, the City Council approved Amendment No. 2 to the Progressive Design-Build Agreement with Bomel Construction Company, Inc., to provide design and construction services related to the H Street Parking Structure Project in an amount not to exceed $45,123,776.00, bringing the total contract amount to $47,516,755.00. The project will provide more than 900 parking stalls in Downtown Fresno.  During construction, the need for a public utility easement was identified so that the project can be energized. Council approval is needed for a public utility easement to be dedicated on a portion of the City property as shown on the attached resolution.

BACKGROUND

The H Street Parking Structure Project (Project) is under construction, consistent with Council action on May 21, 2026 to award the construction phase of the project. The project includes development of a 294,118-square-foot, seven-level open air parking structure with 904 total parking spaces on a 2.26-acre site (project site). The project site is located within the Downtown Core (DTC) base zoning district and has a land use designation of Downtown Core (DTC). The project site is located within the Downtown Community Plan Area and the Fulton Corridor Specific Plan. The project site is comprised of one parcel (Assessor’s Parcel Numbers [APNs] 467-040-43ST, formerly 467-040-20S and 467-040-22S) and is located southwest of the intersection of H Street and Mono Street. In addition, this project requires new utility facilities to be installed in order for this project to be energized.  This public utility easement will provide the area for these new facilities to be constructed.

The City Attorney’s Office has reviewed and approved the attached Resolution as to form.

ENVIRONMENTAL FINDINGS

Pursuant to Class 32/Section 15332 of the California Environmental Quality Act (CEQA) Guidelines, and that none of the exceptions to exemptions set forth in Section 15300.2, the City found the Project to be categorically exempt from the requirements of CEQA, The Project and its Categorical Exemption was adopted by the Fresno City Council on May 21, 2026.

LOCAL PREFERENCE

Local preference was not implemented because the dedication of a public utility easement does not involve bid or award of a construction or services contract.

FISCAL IMPACT

This Project is located in Council District 3 and there will be no City funds involved with this dedication of City property for a public utility easement. The Project is funded by the Governor’s Office of Business and Economic Development (GO-Biz) FY 26 appropriations.
