Body
RECOMMENDATION

The recommendation is to authorize the City of Fresno to enter into a new three year agreement with the 21st District Agricultural Association for $752,661.56 to provide police services at the Fresno District Fair.

EXECUTIVE SUMMARY

An agreement is attached for Council to approve the 21st District Agricultural Association request to contract with the City of Fresno to provide police and law enforcement services for three years at the Fresno District Fair, beginning 2014 through 2016.  The 21st District Agricultural Association has requested that the prior agreement approved by Council on April 24, 2014, which remains unexecuted, be modified to include mutual indemnification language.  This change was requested by the 21st District Agricultural Association and has been approved by the City's Risk Manager and the City Attorney's Office.  No other changes were made to the original contract approved by the City Council.

BACKGROUND

As done in the past years, policing and related law enforcement services will be provided in areas at the fairgrounds that have been mutually agreed upon by Fair Management and Fresno Police Department personnel.

This agreement calls for 4,783 hours of law enforcement services in 2014, totaling $259,227.72 for a 13 day fair.  This agreement calls for 4,314 hours of law enforcement services in 2015 and 2016, totaling $238,507.42, which are both 12 day fairs.  These amounts has been calculated to cover the direct costs incurred by the Police Department for services provided to the Fresno District Fair beginning in 2014 through 2016.  This agreement also contains costs for unforeseen circumstances requiring additional police services.  One hundred contingency hours, totaling $5,401.00 in 2014 and $5,509.00 in both 2015 and 2016 have been built into this agreement.  These contingency funds have been established to protect the Fresno District Fair and the Police Department in the event additional police services are required.

This agreement has been reviewed and approved as to form by the City Attorney's Office and by the Risk Management Division.
