RESOLUTION - Appointing the Members of the Fresno Enhanced Infrastructure Financing District Public Financing Authority

RECOMMENDATION

Approve the appointing the following three Councilmembers and two members of the public to the Fresno Enhanced Infrastructure Financing District (Fresno EIFD) Public Financing Authority (PFA):

1.                     Councilmember Nelson Esparza

2.                     Councilmember Esmeralda Soria

3.                     Councilmember Miguel Arias

4.                     Mr. Mo Bagunu

5.                     Mr. Robert Fuentes

EXECUTIVE SUMMARY

Approval of the attached resolution would appointment five members to the Fresno EIFD PFA, which was formed pursuant to the Resolution of Intention passed by the Fresno City Council on April 23, 2020. 

 

BACKGROUND

On April 23, 2020, Chapter 2.99 of Part 1 of Division 2 of Title 5 of the California Government Code (commencing with Section 53398.50) (the EIFD Law), the City Council passed a Resolution of Intention pursuant establish the Fresno EIFD to finance construction, and/or acquisition, and maintenance of capital improvements and establish a PFA (Council Resolution No. 2020-084).  The instant action is a resolution appointing the members of the PFA. 

Pursuant to EIFD Law, the FPA shall be comprised of three members of the legislative body of the participating agency and two members of the public.  (Government Code 53398.51.1.)  The PFA will conduct the required series of public hearings on the forthcoming Infrastructure Financing Plan as part of the process to formally establish the Fresno EIFD.  (Government Code 53398.66.)  The PFA will also serve as the governing body of the Fresno EIFD.  (Government Code 53398.51(i).) 

The following appointments are presented for approval:

1.                     Councilmember Nelson Esparza

2.                     Councilmember Esmeralda Soria

3.                     Councilmember Miguel Arias

4.                     Mr. Mo Bagunu

5.                     Mr. Robert Fuentes

The proposed resolution sets fourth two-year terms for members.

ENVIRONMENTAL FINDINGS

By the definition provided in the California Environmental Quality Act (CEQA) Guidelines Section 15378, this item is not a project for the purposes of CEQA.

 

LOCAL PREFERENCE

Local preference is not applicable because this item does not involve a bid or award of a contract.

FISCAL IMPACT

Pursuant to Government Code Section 53398.51.1(c), members of the PFA shall not receive compensation but may receive reimbursement for actual and necessary expenses incurred in the performance of official duties.  This item does not involve any anticipated expenditure of funds.
