Approve an agreement with Integrated Designs by SOMAM, Inc., of Fresno, CA in the amount of $103,115 with a not-to-exceed contingency of $10,000 for the design of and general construction documents for the Americans with Disabilities Act (ADA) Upgrades at the City of Fresno Convention Center (Council District 3).

RECOMMENDATION
Staff recommends that City Council approve an agreement with Integrated Designs by SOMAM, Inc., of Fresno, CA for $103,115 with a not-to-exceed contingency of $10,000 for the design of and general construction documents for the ADA Upgrades at the City of Fresno Convention Center and authorize the Public Works Director or designee to sign and execute the standard contract on behalf of the City of Fresno.
EXECUTIVE SUMMARY
The City of Fresno entered into a Consent Decree and Order of Settlement of relief claims which requires the City to perform remedial work at the Convention Center. This agreement with Integrated Designs by SOMAM, Inc., of Fresno, CA, will provide the design work that is required for the remedial work to be performed at the City of Fresno Convention Center. Funding for the design work and the first year of physical improvements were included in the FY2018 budget as previously adopted by the Council.
BACKGROUND
On June 8, 2017, the City of Fresno entered into a Consent Decree and Order of Settlement of relief claims only pertaining to the City of Fresno Convention Center. The Decree and Order requires the City of Fresno perform remedial work to the Convention Center in accordance with the standards set forth in the 2010 ADA Standards for Accessible Design (ADAS) for specific items at each venue within a specified timeframe. To enable the work be done correctly and in the specified timeframe, plans and specifications are required.
In accordance with Administrative Order (A.O.) 6-19, staff sent out requests for Statements of Qualifications (SOQ’s) on July 7, 2017, via FAX, e-mail and published on the City’s website and in the Builder’s Exchange. There were seven SOQ’s received on July 28, 2017; staff short listed and interviewed three respondents. On August 21, 2017, the firm Integrated Designs by SOMAM, Inc., of Fresno, CA, was selected as the most qualified consultant and staff negotiated a fee of $103,115 with a not-to-exceed contingency amount of $10,000 pursuant to A.O. 6-19 for the design and preparation of plans, specifications and cost estimates.
Staff is requesting the approval of the agreement with Integrated Designs by SOMAM, Inc., of Fresno, CA in the amount of $103,115 with a not-to-exceed contingency of $10,000 for the design of plans, cost estimates and general construction documents for the ADA Upgrades at the City of Fresno Convention Center project and authorize the Public Works Director or designee to sign and execute the contract on behalf of the City of Fresno.
The contract has been approved as to form by the City Attorney’s Office.
ENVIRONMENTAL FINDINGS
By definition provided in the California Environmental Quality Act (CEQA) Guidelines Section 15378 this item does not qualify as a “project”, as defined by CEQA.
LOCAL PREFERENCE
Local preference was not implemented, but the selected consultant is a local business.
FISCAL IMPACT
Funding for the design work and the first year of physical improvements for ADA upgrades at the Convention Center were included in the FY2018 budget as previously adopted by the Council. The executed settlement agreement will necessitate additional appropriations over the following four fiscal years, as discussed during the FY2018 Council budget hearings. These dollars were included in the five-year General Fund projections as shown in the FY2018 budget document. The funding will be coming from a combination of General Fund and Arts, Parks and Entertainment Sports (APES) fee increases previously approved by the Council.
