Reject all bids received for Requirements Contract to Furnish and Install Concrete and Paving Repairs at the Fresno-Clovis Regional Wastewater Reclamation Facility. (Bid File 9642) (Council District 3)

RECOMMENDATION
Staff recommends City Council reject all bids received for the Requirements Contract to Furnish and Install Concrete and Paving Repairs at the Fresno-Clovis Regional Wastewater Reclamation Facility (RWRF).
EXECUTIVE SUMMARY
The Department of Public Utilities - Wastewater Management Division (WMD) is seeking a requirements contract for the maintenance of concrete, paved surfaces, and other similar repairs at the RWRF. The sole bid received did not include the required subcontractor detail page and was deemed invalid.
Within 90 days, staff will rebid the requirements contract with updated item specifications. The goal is to attract additional interest and provide ample opportunity to complete the bid documents.
BACKGROUND
The RWRF encompasses an area of over 3,200 acres with miles of paved surfaces and numerous concrete structures that require regular maintenance or repairs due to traffic, heavy equipment, safety, and operational necessity.
The WMD conducted a competitive process to select a contractor to provide concrete and paving repairs at the RWRF. A Construction Bid (Bid) was published in the Business Journal and posted on the City’s Planet Bids on June 1, 2022. GC Builders was the lone prospective contractor to submit a qualifications package by the closing deadline of July 12, 2022. On July 22, 2022, Purchasing informed the Department the contractor failed to submit a subcontractor detail page. This deems the contractor as non-responsive and the Bid invalid.
Upon further review of the Bid, it was determined the specification line items format may have contributed to confusion for prospective bidders. Once proposals are rejected, staff will collaborate with Purchasing to update the bid specification line items and solicit bids for the project.
Staff will rebid the project with updated item specifications. The goal is to attract additional interest and provide ample opportunity to complete all required bid documents.
The City Attorney has reviewed and approved to form.
ENVIRONMENTAL FINDINGS
By the definition provided in the California Environmental Quality Act Guidelines Section 15378, the rejection of all proposals does not qualify as a “project” as defined by the CEQA requirements.
LOCAL PREFERENCE
Local preference is not applicable as this action is not an award of a contract.
FISCAL IMPACT
The rejection of all bids has no fiscal impact on the General Fund or the Wastewater Management Division Enterprise Fund.
