RECOMMENDATION

 

Staff recommends that the City Council award a requirements contract up to $411,611.55 per year for one-year with the option for four, one-year extensions to Witbro Inc. dba Seal Rite Paving & Grading as the lowest responsive and responsible bidder and to authorize the Public Works Director or designee to sign the contract on the City’s behalf.

 

EXECUTIVE SUMMARY

 

The City of Fresno has identified the need for the installation of pavement undulations (speed humps) on select neighborhood streets throughout the City. The award of this requirements contract does not specify the locations of where speed humps are to be installed, rather the award of this requirements contract establishes a firm price, secured through competitive bidding, for a specified time and allows Public Works to order the installation of speed humps as needed. All orders for speed humps will be in accordance with the Department of Public Works Residential Street Speed Hump Policy. Upon approval by the Public Works Traffic and Planning Division, a work order will then be issued for the installation of speed humps.

The contract term is for one year with provisions for four, one-year extensions. This contract will utilize General Fund identified for traffic calming in the FY2023 Public Works budget. This contract may also be funded by City Council directed Neighborhood Improvement Infrastructure funds which are also included in the FY2023 Public Works budget.

 

BACKGROUND

 

The City of Fresno recognizes the need for traffic calming options to slow traffic speeds on residential streets. On October 28, 2021, the City Council rescinded a 2006 policy that prohibited the installation of speed undulations on roadways in the City of Fresno. On February 10, 2022, the Department of Public Works approved a Residential Speed Hump Policy that outlines the procedures and processes for the installation of speed humps on residential streets. Requests for new speed humps will be processed in accordance with the Residential Street Speed Hump Policy. This process involves an application requesting speed humps, evaluation and ranking by Public Works Traffic Engineering, notification of the residents, engineering and design, and construction.

 

To facilitate this new program, Public Works initiated the request for bids process to identify a contractor to construct speed humps. While the Public Works Director may elect to use the Street Maintenance Division paving crew to construct some of the speed humps, the award of this contract allows Public Works to assign work to a contractor so that the Street Maintenance Division crew schedule remains uninterrupted and can remain focused on operating programs such as neighborhood street paving, bridge maintenance, and pothole repair.

 

The installation of speed humps is currently performed by City employees who are members of Local 39. In accordance with the Memorandum of Understanding between the City of Fresno and International Union of Operating Engineers, Local 39, Contracting Out section, Local 39 was notified. The Local 39 Business Representative reviewed the bid documents prior to bidding, and on July 25, 2022, the Business Representative responded that their questions had been answered and that they had no objection.

 

On October 14, 2022, a Notice Inviting Bids was advertised and published in the Business Journal, was posted on the Planet Bids website, and was sent to 10 building exchanges. The specifications were distributed to 9 prospective bidders. Four sealed bid proposals were received and opened in a public bid opening on November 08, 2022. Witbro Inc. dba Seal Rite Paving & Grading is deemed the lowest responsive and responsible bidder.

 

A total of $400,000 of General Funds have been appropriated for FY2023 as part of the Public Works Traffic Calming program.  Although the contract price is slightly above this figure, we’re anticipating other neighborhood improvement and traffic mitigation programs to utilize this contract as well.  Also, this contract is a requirements contract, and the City is not obligated to any minimum purchase. If needed, the City can reduce the amount of pavement undulations sets ordered commensurate with budget availability.

 

Staff recommends that the City Council award a requirements contract to Witbro Inc. dba Seal Rite Paving & Grading of Fresno, California up to $411,611.55 per year with the provision of four, one-year extensions, and authorize the Public Works Director or designee to sign the contract on behalf of the City of Fresno.

 

ENVIRONMENTAL FINDINGS

 

Pursuant to California Environmental Quality Act (CEQA) Guidelines Section 15378, awarding of this contract is not a project for the purposes of CEQA.

 

LOCAL PREFERENCE

 

All bidders qualified for Local Preference and provided proper documentation with their bids.

 

FISCAL IMPACT

 

Appropriations for pavement undulations are included in the Public Works Traffic Calming program and consist of General Fund.
