Actions pertaining to the Fresno Police Officers Association, FPOA-Non-Management for Unit 4
1. ***Adopt a successor Memorandum of Understanding between the City of Fresno and Fresno Police Officers Association (Non-Management Police - Unit 4) (Subject to Mayor’s veto)
2. ***RESOLUTION: Adopt the Third Amendment to FY 2026 Salary Resolution No. 2025-177, amending Exhibit 4, Unit 4 - Non-Management Police (FPOA), to provide a salary increase for respective classes as required by the Memorandum of Understanding between the City of Fresno and Fresno Police Officers Association (Non-Management Police - Unit 4) (Subject to Mayor’s veto)

RECOMMENDATION
It is recommended Council (1) approve the attached successor Memorandum of Understanding (MOU) to implement wages, hours and other terms and conditions of employment for City employees in Unit 4, Non-Management Police, represented by FPOA; and (2) adopt the Third Amendment to FY 2026 Salary Resolution No. 2025-177 to amend Exhibit 4.
EXECUTIVE SUMMARY
The City and Fresno Police Officers Association (Non-Management Police - Unit 4) reached a tentative agreement on a successor MOU which will replace the MOU that expired on June 15, 2025. The MOU provides for an agreement from June 16, 2025 through June 13, 2027, increases to wages, and other changes in terms or conditions of employment.
Upon Council approval of the Third Amendment to the FY 2026 Salary Resolution, Exhibit 4 of the FY 2026 Salary Resolution will be updated to reflect the amended Exhibit 4 as approved by Council.
BACKGROUND
The City and Fresno Police Officers Association (Non-Management Police - Unit 4) started meeting in May 2025 to work towards reaching agreement on a successor MOU and the parties reached a tentative agreement on July 18, 2025. Members of the Association ratified on July 23, 2025.
Changes to the MOU are summarized below.
• Term: Two-year contract effective June 16, 2025 through June 13, 2027.
• Salaries:
o FY26: 3% wage increase effective July 28, 2025.
o FY26: Potential 1% wage increase effective December 29, 2025, contingent on achieved growth metrics.
o FY27: 1% wage increase effective June 15, 2026.
• P.O.S.T. Certificate Pay:
o Adding a process to identify when P.O.S.T. Certificate Pay will be provided to members.
o FY27: 1% increase to Intermediate & Advanced P.O.S.T. Certificate Pay effective June 15, 2026.
• Transfer Portal:
o Modifying language to allow Sergeants assigned to patrol who are on an absence status to participate in patrol schedule sign-ups and allow another Sergeant to “ghost” the absent Sergeant’s detail.
o Modifying language that Officers on probation may not request a transfer to another squad.
o Modifying language that Officers on probation may not request a mutual swapping of detail assignments.
o Adding clarifying language that Officers and Corporals who are patrol unassigned are subject to the provisions of Section 7.4 with respect to the continuation of premium pay.
• Overtime: Adding new language giving preference to personnel assigned to the patrol matrix on voluntary patrol overtime.
• Police Corporal Incentives: Fresno Police Department Corporals would receive an incentive of “experience preference points” in a promotional exam.
• Guaranteed Leave: Modifying language to allow members to be able to cancel Guaranteed Leave requests 15 calendar days or more prior to the requested dates and not have it counted as one of their allowable requests.
• Exempt Units: Updating the list of exempt units from mandatory overtime.
• Sick Leave: Updating the Sick Leave sections to be consistent with state law.
In addition to the above, there was language clean up throughout the MOU.
The City Attorney’s Office has approved the new MOU and Salary Resolution Amendment as to form.
ENVIRONMENTAL FINDINGS
By the definition provided in the California Environmental Quality Act Guidelines Section 15378 this item does not qualify as a “project” and is therefore exempt from the California Environmental Quality Act requirements.
LOCAL PREFERENCE
Local preference is not implicated because this item does not involve public contracting or bidding with the City of Fresno.
FISCAL IMPACT
Approval of the MOU and Salary Resolution Amendment will result in estimated additional salary and benefit expenses of $3,580,790 to the General Fund and $3,735,527 to All Funds in FY26, and $6,572,322 to the General Fund and $6,861,221 to All Funds in FY27, for a total of $10,153,122 to the General Fund and $10,596,748 to All Funds for the term of the MOU, which expires June 13, 2027.
