RECOMMENDATION

 

Staff recommends that City Council approve the Third Amendment to the Consultant Services Agreement (Agreement) with Akel Engineering Group, Inc. (Consultant) for the Sanitary Sewer Master Plan (Project), to extend the term to December 31, 2026, increase the contract amount by $100,000.00, for a revised not-to-exceed amount of $837,492.00, including a $14,000.00 contingency, to continue the on-call sanitary sewer hydraulic modeling services included in the Project, and authorize the Director of Public Utilities (DPU), or designee, to sign the Third Amendment to the Agreement on behalf of the City.

 

EXECUTIVE SUMMARY

 

The Consultant completed the sanitary sewer collection system hydraulic model update and calibration as a critical path Project task to support the master plan hydraulic analysis. DPU also performs hydraulic modeling for certain projects submitted to the City as part of the land development review and approval process. DPU included a Project task for the Consultant to provide on-call hydraulic modeling services for the duration of the Project, and additional time and compensation is needed to continue the on-call hydraulic modeling services through the end of 2026.

 

BACKGROUND

 

DPU is currently in the process of completing a Sanitary Sewer Master Plan that will identify and prioritize capital improvements needed to renew or replace aging sanitary sewer pipelines and pipeline segments that require upsizing to increase conveyance capacity.

 

The City entered into the Agreement with Akel Engineering Group, Inc. on June 1, 2023 to provide professional engineering services for the Sanitary Sewer Master Plan. The First Amendment to the Agreement was executed on December 16, 2024 to extend the Agreement to June 30, 2025 with no increase in compensation.

 

The Second Amendment to the Agreement was executed on August 29, 2025 to extend the Agreement to June 30, 2026, allocate $50,000 of the $64,000 contingency for professional services, and increase the contract amount by $29,492 for additional engineering services, for a revised total of $737,492, including a $14,000 contingency.

 

The Consultant’s scope of services for the Sewer System Master Plan update is organized into eight major tasks that collectively support the City’s long-term wastewater planning program. The Consultant has completed the majority of the tasks, and the preparation of the final Master Plan document will be completed by August 31, 2026. Additional system evaluations of updated demand and infrastructure scenarios will continue to be performed as development projects are submitted to the City for approval.

 

Additional time is needed to complete the Master Plan document, and additional time and compensation are needed to continue the on-call hydraulic modeling services to support development review and utility planning. The Third Amendment to the Agreement will extend the term of the Agreement to December 31, 2026, and increase the contract amount by $100,000 for a revised not-to-exceed amount of $837,492 including a $14,000 contingency.

 

The City Attorney has reviewed the Third Amendment and approved it as to form.

 

ENVIRONMENTAL FINDINGS

 

By the definition of the California Environmental Quality Act (CEQA) Guidelines Section 15378, the amendment of this consultant services agreement is not a “Project” for the purposes of CEQA.

 

LOCAL PREFERENCE

 

Local preference does not apply to these actions because this is an amendment to an existing consultant services agreement.

 

FISCAL IMPACT

 

There is no impact to the General Fund.  Funding for this service is included in the Fiscal Year 2026 capital improvement budget within the Wastewater Enterprise Fund 4500-40501.
