Approve Contract Change Order No. 3 with American Paving Company, to increase Contract Time by thirty-five (35) working days, for the Barstow Avenue Class IV Bikeway Project - Project ID PW00972 (Council District 4).

RECOMMENDATION
Staff recommends that City Council approve Contract Change Order No. 3 with American Paving Company for the Barstow Avenue Class IV Bikeway Project in the amount of $0.00 and an increase in Contract Time by thirty-five (35) working days and authorize the Capital Projects Director or designee to the Contract Change Order on behalf of the City of Fresno.
EXECUTIVE SUMMARY
The purpose of this Contract Change Order is to allow the Contractor thirty-five (35) additional working days due to the delay with material procurement for traffic signal equipment, specifically the 2070LX controllers, 332L cabinets, and the video detection units, that are identified on the construction drawings to be installed along Barstow Avenue at Fresno Street, First Street, Millbrook Avenue, and Cedar Avenue. The impact of this delay resulted in the Contractor not being able to work on multiple items of work at once. The remaining work, asphalt overlay, slurry seal, and striping, was completed on schedule and avoided traffic impacts to Fresno State football games. There is no cost to the contract for this Contract Change Order.
BACKGROUND
On March 9th, 2023, a Contract was awarded in the amount of $2,234,648 to American Paving Company, for the Barstow Avenue Class IV Bikeway Project. The Notice to Proceed was issued with a start date of June 14, 2023, and a completion date of September 7, 2023. There have been two (2) Contract Change Orders executed to date totaling $41,475, resulting in a revised contract price of $2,276,123. There have been six (6) days previously added to the contract time by executed Contract Change Orders, five (5) approved suspension days, and one (1) approved weather day resulting in a revised contract completion date of September 22, 2023.
The traffic signal equipment was approved and ordered in early July 2023 and estimated to be shipped in January 2024. The duration of the manufacturing, delivery, and procurement process is approximately six (6) months which delays the construction of the traffic signal modifications along Barstow Avenue and contributed to the delay in the overall completion of the project.
Contract Change Order No. 3 will add thirty-five (35) working days to the contract time, no change to the contract price, and will result in a revised computed contract completion date of November 13, 2023. Additional suspension days may occur depending on the arrival of the equipment and the progression of the remaining work, thus resulting in a later actual completion date.
ENVIRONMENTAL FINDINGS
On March 9, 2023, Council adopted a finding of Categorical Exemption set forth in CEQA Guidelines, Section 15301/Class 1 (Existing Facilities), which exempts the repair and maintenance of existing facilities that involves negligible or no expansion of an existing use. These exemptions apply because this project involves the partial reconstruction of existing roadway, installation of bicycle facilities, and partial reconstruction of traffic signals, none of which involves the expansion of the roadway. Approval of the contract change order does not modify the scope or impact the previous findings.
LOCAL PREFERENCE
Local preference was not implemented based on conditions of state funding.
FISCAL IMPACT
The Barstow Avenue Class IV Bikeway project is located in Council District 4. The project is funded with local Measure C Bike Lane and Street Maintenance funding, Measure P Safe Walking and Biking Trails funding, and a small amount of General Fund used to initiate the design phase. Contract Change Order No. 3 will have no impact to the General Fund.
