RECOMMENDATIONS

 

Staff recommends that Council (1) adopt a finding of Categorical Exemption per staff’s determination, pursuant to Section 15302/Class 2 of the California Environmental Quality Act (CEQA) Guidelines, for the Rotary West Park Fencing Improvements Project (2) approve conditional license between the City of Fresno and Fresno Metropolitan Flood Control District, and authorize the City Manager or designee to sign the conditional license on behalf of the City of Fresno (3) award a construction contract in the amount of $396,000 to Alliance Construction Solutions, Inc., of Madera, California, as the lowest responsive and responsible bidder for the Rotary West Park Fencing Improvements Project (Project), and authorize the Capital Projects Director or designee to sign the standardized construction contract on behalf of the City of Fresno.

 

EXECUTIVE SUMMARY

 

The Capital Project Department seeks to award a construction contract to Alliance Construction Solutions, Inc. following a competitive bidding process which identified them as the lowest responsive and responsible bidder in the amount of $396,000 for the Rotary West Fencing Improvements Project.  The Project will replace the existing chain link fencing at Rotary West Park located at 3202 East Gettysburg Avenue with wrought iron style fencing and gates.  The Project will be funded with American Rescue Plan Act (ARPA) and Measure P, Expenditure Category 1 allocations adopted in the Fiscal Year 2024 (FY24) Budget.

 

BACKGROUND

 

Rotary West Park is a 17.86-acre park located within Fresno Metropolitan Flood Control Districts Retention Basin on the south side of East Gettysburg Avenue between North First Street and North Millbrook Avenue.  The park contains a tot lot area, picnic tables, restroom building, a basketball court, and baseball fields with sports lighting.  The PARCS Department wishes to upgrade the existing chain link fencing to wrought iron style fencing. Pursuant to these goals, the City entered into an agreement with Blair, Church & Flynn dated July 20, 2023, for design and preparation of construction documents for the Project.

 

A Notice Inviting Bids was advertised and published in the Business Journal, Planet Bids, and posted on the City’s website on September 25, 2024.  The Project plans and specifications were distributed to sixteen (16) prospective bidders and posted at ten (10) building exchanges.  One (1) on-line bid proposal was received and opened in a public bid opening on October 24, 2024, with the bid amount of $396,000.  Alliance Construction Solutions, Inc. was determined to be the lowest responsive and responsible bidder in the amount of $396,000. The bids will expire on December 27, 2024. If the bids are rejected or expire, the Project must be rebid which will result in a delay to the Project and the loss of ARPA funding. 

 

The Community Workforce Agreement (PLA), adopted by Council in September 2021, does not apply to this contract because the engineer’s estimate for this project was less than $1 million, pursuant to the terms of the PLA.

 

Staff recommends Council adopt a finding of a Categorical Exemption per staff’s determination, pursuant to Section 15302/Class 2 of the CEQA Guidelines, for the Rotary West Park Fencing Improvements Project, approve a conditional license between the City of Fresno and Fresno Metropolitan Flood Control District for the replacement of chain link fencing with wrought iron style fencing, and authorize the City Manager or designee to sign the conditional license on behalf of the City of Fresno, and award a construction contract to Alliance Construction Solutions, Inc. of Madera, California, in the amount of $396,000, as the lowest responsive and responsible bidder for the Rotary West Park Fencing Improvements Project and authorize the Capital Projects Director or designee to sign the standardized construction contract on behalf of the City of Fresno.

 

The City Attorney’s Office has reviewed and approved all documents as to form.

 

ENVIRONMENTAL FINDINGS

 

Staff has determined that a Categorical Exemption is appropriate based on Section 15302/Class 2, which consists of replacement or reconstruction of existing structures where the new structure will be located on the same site as the structure replaced and will have substantially the same purpose and capacity as the structure replaced.  The new wrought iron style fencing will be placed in the same location of the removed chain link fencing on the north side of the property therefore, not changing the purpose or increasing the capacity of use.

 

Furthermore, staff has determined that none of the exceptions to Categorical Exemptions set forth in the CEQA Guidelines, Section 15300.2 apply to this Project.  Staff recommends that Council, based upon its own independent judgment, adopt a finding of a Categorical Exemption per Staff determination, pursuant to Section 15302/Class 2 of the CEQA Guidelines for the Rotary West Park Fencing Improvements Project.

 

LOCAL PREFERENCE

 

Local Preference was not implemented because of federal ARPA funding.

 

FISCAL IMPACT

 

The Rotary West Park Fencing Improvements Project is located in Council District 4 and will have no impact to the General Fund.  The Project will be funded utilizing ARPA and Measure P, Expenditure Category 1 funds.
