RECOMMENDATION
Staff recommends that the City Council approve Contract Change Order No. 09 with Granite Construction Company, which increases the contract amount by $80,435.84, for a revised contract total of $3,641,429.92, with no additional working days for over and under runs in the Contract Bid Item Quantities for the Downtown Neighborhood Beautification and Cleanup Project and authorize the Capital Projects Department Director, or designee, to sign this Contract Change Order No. 9 on the City’s behalf.
EXECUTIVE SUMMARY
On June 29, 2023, a contract was awarded in the amount of $3,260,116.00 to Granite Construction Company of Fresno, California for the Downtown Neighborhood Beautification and Cleanup Project on Belmont Avenue from Abby Street to Millbrook Avenue, SR-180 at Blackstone Avenue, SR-180 at Abby Street, SR-180 at Fresno Street, SR-180 at First Street, and at the north wall of the Romain Community Center at SR-180 and First Street. City Council approval of Contract Change Order No. 09 in the amount of $80,435.84 with no additional working days is necessary to compensate Granite Construction Company for over and under runs in the bid item quantities. This increase will result in a revised contract total of $3,641,429.92. The funding for this Contract Change Order is funded by the California Department of Transportation for the Clean California Local Grant Program (CCLGP).
BACKGROUND
On Jun 29, 2023, a contract was awarded in the amount of $3,260,116.00 to Granite Construction Company for the Downtown Neighborhood Beautification and Cleanup Project. The Notice to Proceed was issued with a start date of September 7, 2023, and a contract completion date of March 28, 2024.
There have been eight (8) prior Contract Change Orders approved totaling $300,878.07, resulting in a revised contract total of $3,560,994.08. There have been twenty-six (26) days added to the contract time by previously executed Contract Change Orders, in addition to six (6) weather days, and fifty-seven (57) suspension days added resulting in a revised contract completion date of August 2, 2024. Substantial completion for the project was issued on August 1, 2024.
City Council approval of Contract Change Order No. 09 for an additional $80,435.84 is required by Resolution 2017-158, which sets the approval thresholds for individual Contract Change Orders which exceed 1% of the total contract price or $100,000.00 or aggregate Contract Change Orders that exceed 10% of the original Contract amount. The amount of Contract Change Order No. 09 is $80,435.84, which is an aggregate total of 11.7% of the original Contract amount. This increase will result in a revised contract total of $3,641,429.92.
In May 2022, the City was awarded grant funds in the amount of $5,000,000.00 from the CCLGP to fund the Downtown Fresno Neighborhood Beautification and Cleanup Project. Civil infrastructure improvements for the project were designed by the City’s Public Works, Design Services Section with Landscape and Irrigation infrastructure improvements designed by the City’s on-call consultant. No right-of-way was acquired for this project.
The scope of work includes, but is not limited to, infrastructure and non-infrastructure elements focused on urban greening, improved walkability, community placemaking, and litter cleanup. The infrastructure component includes reconstruction of existing medians to include the removal of median curb, gutter and asphalt paving, saw cutting, adjustment of water valves and manhole lids to grade, and installation of curb and gutter, landscaping, irrigation, and sidewalk tree wells. Additionally, the improvements will include ADA upgrades to forty-seven (47) pedestrian ramps, updates to five (5) existing FAX Bus Stop locations to include new bus shelters, concrete bus stop pads, trash receptacles, seating, bus stop lighting and appurtenances.
The non-infrastructure components include the commissioning of eight (8) murals to be painted by eight (8) local artists to encourage community placemaking and decrease graffiti, the establishment of ‘Beautify Fresno’ Clubs at Webster and Hidalgo Elementary Schools to organize eight (8) Beautify Fresno Club-organized cleanup events, the implementation of Fresno’s ‘Beautify Fresno’ program to organize four (4) volunteer-based cleanup events to be held at Webster, Hidalgo, and Anthony Elementary School neighborhoods, as well as the creation and launch of two (2) Anti-litter campaigns serving the target area of the CCLLGP award.
The Community Workforce Agreement (PLA), adopted by City Council in September 2021, was included as part of the requirements pursuant to the terms of the PLA.
Staff recommends that the City Council authorize the Capital Projects Department Director, or designee, to sign this Contract Change Order No. 9 on the City’s behalf.
ENVIRONMENTAL FINDINGS
Based on staff analysis, it was determined that no adverse environmental impacts would occur as a result of the proposed project and none of the exceptions to categorical exemptions set forth in the CEQA Guidelines Section 15300.2 apply to this project. On April 27, 2023, the Council adopted a finding of Categorical Exemption pursuant to Environmental Assessment No. PW01012, dated April 12, 2023, and a Notice of Exception was filed with the Fresno County Clerk’s office and with the State Clearing House, Office of Planning and Research (OPR) on May 1, 2023, and was posted until June 6, 2023
LOCAL PREFERENCE
Local preference is not applicable due to State of California funding requirements.
FISCAL IMPACT
The Downtown Fresno Neighborhood Beautification and Cleanup Project is located within Council Districts 1, 3 & 7. The project is fully funded by a CCLGP grant, and this Contract Change Order will have no impact on the General Fund.
