RECOMMENDATION
Staff recommends the City Council adopt a Resolution authorizing the Public Works Director, Capital Projects Director, or their respective designee(s) to negotiate and execute, on behalf of the City, all project-related documents and agreements, including amendments, with utility companies, public or otherwise, for public work of improvement no greater than the formal bid limit.
EXECUTIVE SUMMARY
Adoption of the Resolution will provide authority to the Public Works Director and the Capital Projects Director or their respective designee(s) to negotiate and execute, on behalf of the City, all project-related documents and agreements, including amendments, of a routine nature with utility companies, public or otherwise, in an effort to meet project and funding obligation deadlines and public expectations for project delivery, subject to approval as to form by the City Attorney’s Office and compliance with Administrative Order 2-1.
BACKGROUND
On January 12, 2012, the Council adopted Resolution 2012-1 authorizing the Public Works Director to execute agreements of a routine nature for Underground Utility District projects that have been previously approved and funded through Rule 20A allocations funds from PG&E. The proposed Resolution expands on this to include the Capital Projects Director and extends authority to all situations in which the City must negotiate and execute project related documents and/or agreements, including amendments, with utilities, public or otherwise, related to the completion of a public work of improvement including but not limited to utility or facility relocations, utility or facility adjustments, and service line and/or distribution line extensions, the cost of which is no greater than the formal bid limit, and therefore not subject to an advertised competitive bidding process pursuant to City Charter section 1208(a).
Adoption of the Resolution authorizing the Public Works Director, Capital Projects Director or their respective designee(s) to negotiate and execute, on behalf of the City, all project related documents and agreements, including amendments, with utilities, public or otherwise, such as PG&E and AT&T, for public work of improvement, no greater than the formal bid limit, will streamline the project delivery timelines, subject to approval as to form by the City Attorney’s Office and compliance with Administrative Order 2-1.
The City Attorney’s Office has reviewed and approved the Resolution as to form.
