RECOMMENDATION
Staff recommends City Council approve the Second Amendment to the Professional Architectural Services Agreement with Temple-Andersen-Moore-Architects, LLP, in the amount of $8,500, increasing the total contract amount to $206,380, with an additional contingency amount not to exceed $50,000 due to increased scope of services for development of structural remediation improvement plans for the south building at the Paul “Cap” Caprioglio Community Center and authorize the Capital Projects Director or designee to execute the Second Amendment on behalf of the City of Fresno.
EXECUTIVE SUMMARY
The City of Fresno Parks, After School, Recreation and Community Services Department (PARCS) proposes to design and construct accessibility improvements and reconfigure and modernize the interior spaces at both the north and south buildings at the Paul “Cap” Caprioglio Community Center at the southwest corner of Bulldog Lane and Sixth Street. On August 27, 2020, Council approved the Professional Architectural Services Agreement between the City and Temple-Andersen-Moore-Architects, LLP, which included the following scope of work: where applicable, provide assessment, recommendation, and construction documents for accessibility and interior modernization improvements. Staff recommends approval of the Second Amendment to the Professional Architectural Services Agreement with Temple-Andersen-Moore Architects, LLP, to facilitate the development of general construction documents necessary for additional structural remediations for the south building in order to enhance guest experience and safety. The contract amendment for professional engineering design services will be funded with Measure P allocations adopted in the Fiscal Year 2024 (FY24) Budget.
BACKGROUND
The City adopted the Clean and Safe Neighborhood Parks Transaction and Use Tax (Measure P) which included funds for the planning, designing, engineering, and permitting activities for improving and maintaining safe, clean neighborhood parks, and to maintain and improve after-school, youth, and senior recreational programs. The PARCS Department is aiming to fulfill the goals of Measure P through the Paul “Cap” Caprioglio Community Center Remodel Project’s planned improvements including, but not limited to, removal and replacement of the heating, ventilation, and air conditioning (HVAC) system, accessibility and energy efficiency improvements, and reconfiguration of the existing space to optimize future programs and activities.
Pursuant to these goals, the City entered into an agreement with Temple-Andersen-Moore Architects, LLP., dated August 27, 2020, for a total contract amount of $127,880, with a contingency amount of $10,000. The scope of work originally included the following: providing assessment, recommendations, and construction documents for accessibility improvements, and reconfiguration and modernization of interior spaces at both the north and south buildings. On June 16, 2022, additional architectural and structural engineering services for structural remediations necessary for the HVAC system and interior improvements, as required for original scope of work, expended the full contingency amount of $10,000, for a total contract amount of $137,880.
Due to funding availability, construction of the improvements to the north building began immediately to ensure the new community center site was open and operational. A bid proposal for construction of the planned north building improvements was received on December 3, 2021, and following full execution of the Job Order Contract, City staff issued the Notice to Proceed for construction on May 27, 2022. Construction of the planned improvements at the north building was substantially completed on May 25, 2023.
The First Amendment to the original Professional Architectural Services Agreement dated November 17, 2023, in the amount of $60,000, increased the total contract amount to $197,880, with no remaining contingency, for providing construction documents for removal and replacement of the HVAC system at the north building, minor repairs of existing roof trusses for the south building, and repackaging of the approved plans and specifications for bidding and construction of all planned improvements per the original scope of work for the south building.
The Project’s structural engineer of record performed additional inspections and evaluations of the roof truss framing of the north building on December 19, 2023. Recommendations were provided in a subsequent letter submitted to the City on December 21, 2023, and in understanding both the north and south building roof truss framing systems are of similar profile, spacing, and manufacturer, recommendations for additional structural remediations at the south building were proposed. No delays to the project are anticipated due to this additional scope of work.
Staff now recommends approval of the Second Amendment to the Professional Architectural Services Agreement with Temple-Andersen-Moore-Architects, LLP, in the amount of $8,500, increasing the total contract amount to $206,380, with an additional contingency amount not to exceed $50,000 for additional design support services for development of structural remediation improvement plans for the south building and authorize the Capital Projects Director or designee to execute the amendment to the original agreement on behalf of the City. The contract amendment for professional engineering design services will be funded with Measure P allocations made in the adopted Fiscal Year 24 Budget.
The City Attorney’s Office has reviewed and approved the proposed agreement as to form.
ENVIRONMENTAL FINDINGS
Contract amendment does not qualify as a project pursuant to California Environmental Quality Act (CEQA) Guidelines § 15378.
LOCAL PREFERENCE
Temple-Andersen-Moore-Architects, LLP, is a local business, as defined by the Fresno Municipal Code.
FISCAL IMPACT
The proposed project is in Council District 4. The project is funded from appropriations included in the FY24 annual appropriations resolution for Measure P, expenditure category 2 (New Neighborhood Parks; Senior and Youth Recreation Facilities) and there is no impact to the General Fund.
