Adopt Resolution of Intention to amend Annexation Map No. 14, Final Tract Map No. 5232, of the City of Fresno Community Facilities District No. 11 (“CFD No. 11”).

 

EXECUTIVE SUMMARY

 

The landowners of territory within the boundaries of Annexation Map No. 14, Final Tract Map No. 5232, of CFD No. 11 have submitted a proposed subdivision as Final Tract Map No. 6103 to further subdivide existing lots, increasing the total number of lots by fifteen.  This requires modification to the previously recorded amended Annexation Map No. 14 and requires Council approval per City Law.  As the officer having charge and control of the Services of CFD No. 11, the Public Works Director is requesting to increase the number of lots within Annexation No. 14 of CFD No. 11 by amending Annexation Map No. 14.  This Amended Annexation Map No. 14 will supersede all previously recorded maps and is required to record within ten days after Council approval.  No further action is required upon recordation.

 

BACKGROUND

 

On June 13, 2013, the Council of the City of Fresno (“Council”) adopted Resolution No. 2013-84 to amend the boundaries of Annexation No. 14, Final Tract Map No. 5232, of the City of Fresno Community Facilities District No. 11 (“CFD No. 11”) per the City of Fresno Special Tax Financing Law, Chapter 8, Division 1, Article 3 of the Fresno Municipal Code (“City Law”) and the Streets and Highways Code, commencing with Section 3110.

 

The amended boundaries for Annexation Map No. 14 of CFD No. 11 were recorded on June 14, 2013 at Book 43, Page 89, of Assessment and Community Facilities Districts in the Office of the Recorder, County of Fresno, California.

The attached Resolution has been approved as to form by the City Attorney’s Office.

 

ENVIRONMENTAL FINDINGS

 

By the definition provided in the California Environmental Quality Act Guidelines Section 15378 this item does not qualify as a “project” and is therefore exempt from the California Environmental Quality Act requirements.

 

LOCAL PREFERENCE

 

Local preference was not considered since this item does not include a bid or award of a construction or services contract.

 

FISCAL IMPACT

 

No City funds will be involved.  All costs for incidental expenses are incorporated into the Services for Annexation No. 14 by CFD No. 11.
