RECOMMENDATION

 

Staff recommends that the City Council conduct a public meeting to allow testimony concerning the proposed renewal of Fresno-Clovis Tourism Business Improvement District (FCTBID).

 

EXECUTIVE SUMMARY

 

On October 30, 2025, the City Council approved a Resolution of Intent to Renew the Fresno-Clovis Tourism Business Improvement District (FCTBID) and a Resolution Requesting Consent of the City of Clovis to Renew the FCTBID. To renew a property-based improvement district, the enabling legislation, Property and Business Improvement District Law of 1994, Streets and Highways Code section 36600 et seq. requires the public body hold a public meeting wherein comments on the renewal of the District may be heard.  There is no action requested of the City Council on this item.

 

Background

 

The Fresno-Clovis Tourism Business Improvement District (FCTBID) was formed in 2010 for a five-year term and subsequently renewed on December 18, 2014. As the FCTBID reaches the end of its second term, businesses have expressed a desire to renew it. On October 30, 2025, the Fresno City Council approved the Resolution of Intent to Renew the FCTBID and a Resolution Requesting Consent of the City of Clovis to Renew the District. 

 

On November 3, 2025 a written notice was sent to all assessed business owners notifying them of the approval of the Resolution of Intention and providing them with the opportunity to protest the renewal of the TBID.

 

On November 3, 2025, the City of Clovis City Council approved the Resolution Requesting Consent to Renew the District. 

 

The Property and Business Improvement District Law of 1994 requires that the municipal body renewing the District hold a public meeting after the Resolution of Intent is approved, and prior to the approval of a Resolution of Formation.  Notice of the public meeting was sent to all businesses proposed to be within the district on November 3, 2025.  There is no Council action requested on this item. All written and verbal comments provided on November 20, 2025, at the public meeting will be collected.

 

If written protests are received from the owners of businesses in the renewed FCTBID which will pay fifty percent (50%) or more of the assessments proposed to be levied and protests are not withdrawn so as to reduce the protests to less than fifty percent (50%), no further proceedings to levy the proposed assessment against such businesses shall be taken for a period of one (1) year from the date of the finding of a majority protest by the Council (December 18, 2025).

 

If no opposition is received, or opposition representing less than 50% of the proposed assessment is received up until the close of the final hearing on December 18, 2025, Council may consider the renewal of the FCTBID on December 18, 2025.

 

ENVIRONMENTAL FINDINGS

 

Pursuant to California Environmental Quality Act (CEQA) Guidelines Section 15378, this item is not a project for the purposes of CEQA.

 

LOCAL PREFERENCE

 

Local preference is not applicable because this is not an agreement for materials, supplies, equipment or services.

 

FISCAL IMPACT

 

None immediately.  The Cities of Fresno and Clovis shall be paid a fee equal to 1% of the amount of assessment collected to cover their costs of collection and administration.   Because the FCTBID programs are intended to increase visitation to the Cities, there may be an increase in transient occupancy tax and sales tax collections.
