Title
Actions pertaining to the Rotary East Pickleball Courts Project (Bid File No. 12500848) (Council District 6):
1. Adopt a finding of Categorical Exemption per staff’s determination, pursuant to section 15061(b)(3) of the California Environmental Quality Act (CEQA) Guidelines for the Rotary East Pickleball Courts Project;
2. Award a construction contract in the amount of $854,126.40 for the Base Bid only, with Harris Development Corp. dba HBC Enterprises of Clovis, California as the lowest responsive and responsible bidder for the Rotary East Pickleball Courts Project.

RECOMMENDATIONS
Staff recommends the City Council (1) adopt a finding of Categorical Exemption per staff’s determination pursuant to Section 15061(b)(3) of the California Environmental Quality Act (CEQA) Guidelines, and (2) award a construction contract in the amount of $854,126.40 for the Base Bid only to Harris Development Corp. dba HBC Enterprises of Clovis, California, as the lowest responsive and responsible bidder for the Rotary East Pickleball Courts Project (Project), and authorize the Capital Projects Director or designee to sign the standardized construction contract on behalf of the City of Fresno (City).
EXECUTIVE SUMMARY
The Capital Projects Department (CPD) seeks to award a construction contract to Harris Development Corp. dba HBC Enterprises following a competitive bidding process which identified them as the lowest responsive and responsible bidder in the amount of $854,126.40 for the Base Bid only for the Rotary East Pickleball Courts Project. The scope of work includes the construction of eight pickleball courts, court lighting, court fencing and benches. The Project will be funded utilizing Fiscal Year 2025 appropriations from American Rescue Plan Act (ARPA), Park Impact Fees, Measure P Category 1 and District Infrastructure Improvement Funds.
BACKGROUND
Rotary East Park is located on the northeast corner of Cedar and Sierra Avenues. The City of Fresno Parks, After School, Recreation and Community Services Department (PARCS) proposes to construct eight pickleball courts, court lighting, court fencing and benches. The Project will support the growth of the pickleball community in the surrounding area and will cultivate an environment that promotes health and social interaction.
On June 13, 2023, Council approved a Consultant Services Agreement with Quad Knopf, Inc., to develop construction drawings for the Rotary East Pickleball Courts Project. CPD now seeks to award a construction contract to construct the proposed improvements.
A Notice Inviting Bids was advertised and published on the City’s website, Planet Bids and the Business Journal on October 4, 2024. The Project plans and specifications were distributed to 32 prospective bidders and posted at eight (8) Building Exchanges. Five (5) sealed bid proposals were received and publicly opened on November 05, 2024, with base bid amounts ranging from $854,126.40 to $1,330,583.00. Harris Development Corp. dba HBC Enterprises of Clovis, California was determined to be the lowest responsive and responsible bidder in the amount of $854,126.40 for the Base Bid only. The bids will expire on January 08, 2025. If the bids are rejected or expire, the Project must be rebid which will result in a delay to the Project.
The Community Workforce Agreement (PLA), adopted by Council in September 2021, does not apply to this contract because the engineer’s estimate for this project was less than $1 million, pursuant to the terms of the PLA.
Staff recommends that Council adopt a finding of Categorical Exemption pursuant to section 15061(b)(3) of the CEQA Guidelines, award a construction contract in the amount of $854,126.40 for the Base Bid only, to Harris Development Corp. dba HBC Enterprises, as the lowest responsive and responsible bidder for the construction of the Rotary East Pickleball Courts Project, and authorize the Capital Projects Director or designee to sign a standardized construction contract on behalf of the City. The Project will be funded utilizing Fiscal Year 2025 appropriations from ARPA, Park Impact Fees, Measure P Category 1 and District Infrastructure Improvement Funds.
The City Attorney’s Office has reviewed and approved the contract documents as to form.
ENVIRONMENTAL FINDINGS
Staff has reviewed the scope and nature of this Project and determined that the Project is categorically exempt from the requirements of CEQA pursuant to Section 15061(b)(3). This exemption applies based on the analysis provided by Staff that there is no possibility that the Project activities would have a significant impact on the environment.
LOCAL PREFERENCE
Local Preference was not implemented because of federal ARPA funding.
FISCAL IMPACT
The Rotary East Pickleball Courts Project is located in Council District 6 and will have no impact to the General Fund. The Project will be funded utilizing Fiscal Year 2025 appropriations from ARPA, Park Impact Fees, Measure P Category 1 and Council District Infrastructure Funds.
