Actions pertaining to the Paul “Cap” Caprioglio Community Center Remodel Project Bid File No. 12403201-1: (Council District 4)
1. Adopt a finding of Categorical Exemption from the California Environmental Quality Act (CEQA) per staff’s determinations, pursuant to Section 15301/Class 1 of the California Environmental Quality Act Guidelines, Environmental Assessment No. PC00212, for the Paul “Cap” Caprioglio Community Center Remodel Project;
2. Award a construction contract in the amount of $1,299,850.00 to MSH Development Group Inc., of Valencia, California, as the lowest responsive and responsible bidder for the Paul “Cap” Caprioglio Community Center Remodel Project.

RECOMMENDATIONS
Staff recommends that the City Council (1) adopt a finding of Categorical Exemption from the California Environmental Quality Act (CEQA) per staff’s determinations, pursuant to Section 15301/Class 1 of the CEQA Guidelines, Environmental Assessment No. PC00212 (2) award a construction contract to MSH Development Group Inc., of Valencia, California, in the amount of $1,299,850.00 as the lowest responsive and responsible bidder for the Paul “Cap” Caprioglio Community Center Remodel Project (Project), and authorize the Capital Projects Director or designee to sign the construction contract on behalf of the City of Fresno (City).
EXECUTIVE SUMMARY
The Capital Project Department seeks to award a construction contract to MSH Development Group Inc., following a competitive bidding process which identified them as the lowest responsive and responsible bidder in the amount of $1,299,850.00. The project will construct accessibility improvements and reconfigure and modernize interior spaces at the south building, along with Heating, Ventilation, and Air Conditioning (HVAC) improvements at both the north and south buildings at the Paul “Cap” Caprioglio Community Center at the southwest corner of Bulldog Lane and Sixth Street. The construction contract will be funded with Measure P allocations adopted if the Fiscal Year 25 (FY25) Budget.
BACKGROUND
The City adopted the Clean and Safe Neighborhood Parks Transaction and Use Tax (Measure P) which included funds for improving and maintaining safe, clean neighborhood parks and playgrounds. Pursuant to these goals, the City entered into an agreement with Temple-Andersen-Moore Architects, LLP., dated August 27, 2020, for the design and preparation of construction documents for the Project. The Parks, After School, Recreation and Community Services Department (PARCS) now aims complete the construction of the Project’s planned improvements including, but not limited to, accessibility improvements, energy efficiency improvements, and reconfiguration of the existing space to optimize future programs and activities. Similar improvements were completed in the north building in September 2024. The Project also includes removal and replacement of the HVAC system at the both the north and south buildings of the community center.
This is the second advertisement of this project for prospective bidders. The first Notice Inviting Bids was advertised on July 19, 2024 with a public bid opening on August 13, 2024. The prospective bidders were deemed non-responsive, and a rejection of bids was approved by Council on September 26, 2024.
The subsequent Notice Inviting Bids was advertised and published in the Business Journal, Planet Bids, and posted on the City’s website on September 26, 2024. The Project plans and specifications were distributed to thirty-one (31) perspective bidders and posted at Five (5) building exchanges. One (1) sealed bid proposal was received and opened in a public bid opening on October 29, 2024, with a bid amount of $1,299,850.00. MSH Development Group Inc., of Valencia, California, was determined to be the lowest responsive and responsible bidder. The bids will expire on January 1, 2025. If the bids are rejected or expire the Project must be rebid which will result in a delay to the Project.
This contract is covered by the Community Workforce Agreement (PLA), adopted by Council in September 2021. The Contractor shall become signatory to the PLA by executing the Agreement To Be Bound.
Staff recommends Council adopt a finding of Categorical Exemption per staff’s determinations, pursuant to Section 15301/Class 1 of the California Environmental Quality Act Guidelines, Environmental Assessment No. PC00212, and award a construction contract in the amount of $1,299,850.00 to MSH Development Group Inc., of Valencia, California, as the lowest responsive and responsible bidder, and authorize the Capital Projects Director or designee to sign and execute the standardized contract on behalf of the City of Fresno.
The City Attorney’s Office has reviewed and approved all documents as to form.
ENVIRONMENTAL FINDINGS
Staff performed an environmental assessment of this Project and determined that it falls within the Categorical Exemption set forth in CEQA Guidelines, Section 15301/Class 1 for Existing Facilities because the Project includes minor alterations to existing facilities involving negligible expansion of the existing use. Please see the attached Environmental Assessment for more information.
None of the exceptions to Categorical Exemptions set forth in the CEQA guidelines Section 15300.2 apply to this project. Therefore, a categorical exemption from CEQA, as noted above, has been prepared for the project.
LOCAL PREFERENCE
MSH Development Group Inc., is a not local business, as defined by the Fresno Municipal Code. However, as only one bid was received, MSH Development Group Inc., is deemed the lowest responsive and responsible bidder for the Paul “Cap” Community Center Remodel Project.
FISCAL IMPACT
The Paul “Cap” Community Center Remodel Project is in Council District 4 and will have no impact to the General Fund. The Project will be funded with Measure P allocations adopted if the FY25 Budget.
