RECOMMENDATION

 

Staff recommends City Council approve the Sixth Amendment to the Consultant Services Agreement, dated April 27, 2017, with QK Consulting Engineers Inc. in the amount of $5,928, increasing the total contract amount to $86,998, for the Jensen Avenue Overlay from State Route 41 to Martin Luther King Jr. Boulevard Project, and to authorize the Public Works Director or designee to execute the amendment to the agreement on behalf of the City of Fresno.

 

EXECUTIVE SUMMARY

 

The design for the Jensen Avenue Overlay Project from State Route 41 to Martin Luther King Jr. Boulevard is nearly complete and preparing to advertise for bid in the coming months. Through the final design coordination, City staff and the Consultant have identified the need for additional design services to address unforeseen utility conflicts and to provide additional project management support. Staff recommends City Council approve the Sixth Amendment to the Consultant Services Agreement with QK Consulting Engineers for $5,928, increasing the total contract amount to $86,998 for professional civil engineering design services and preparation of construction documents.

 

The Consultant Services Agreement with QK Consulting Engineers includes the design services for the Jensen Avenue Overlay Project, as well as the Ashlan Avenue Overlay Project from First Street to Millbrook Avenue, which was constructed in 2020. The proposed amendment is only for design services on the Jensen Avenue Overlay Project. The amount of the Sixth Amendment will be funded with a Regional Surface Transportation Program (RSTP) Federal grant and Proposition 111 Special Gas Tax funds.

 

BACKGROUND

 

The City of Fresno Public Works Department has identified a need for street surface restoration along Jensen Avenue and Ashlan Avenue. In December of 2015, the City applied for RSTP funds for the design and construction phases of the two separate asphalt overlay projects. Approximately 1.0 mile along Jensen Avenue, from State Route 41 to Martin Luther King Boulevard is in need of surface restoration and 0.5 miles along Ashlan Avenue, from First Street to Millbrook Avenue was in need of surface restoration.

 

In October of 2016, staff advertised a Request of Qualification (RFQ) to interested qualified firms in accordance with Administrative Order (A.O.) 6-19 via the City’s website, receiving six (6) Statements of Qualifications (SOQ) in November of 2016. In January of 2017, the City interviewed the top five (5) qualified firms and QK Consulting Engineers was determined to be the top qualified consultant for the Jensen Avenue Overlay Project and Ashlan Avenue Overlay Project. The original agreement dated April 27, 2017, with QK Consulting Engineers totaled $66,210, with a $17,550 contingency, for both Jensen Ave and Ashlan Ave Overlay Projects. The budget for both projects is as follows: the Jensen Avenue Overlay Project from State Route 41 to Martin Luther King Boulevard ($35,530, with a $10,120 contingency) and the Ashlan Avenue Overlay Project from First Street to Millbrook Avenue ($30,680, with a $7,430 contingency).

 

City staff identified additional scope and pursued multiple Amendments with QK Consulting Engineers to add the additional scope.  On July 2, 2019, the First Amendment was executed for $2,610, which included additional design on Bond Avenue for the Ashlan Avenue Project. On July 27, 2019, the Second Amendment to the agreement was executed to design a full street reconstruction of the Jensen Avenue Project for $7,500. On September 14, 2020, the Third Amendment to the agreement was executed to modify the existing plan set to relocate pedestrian push buttons per City standards at the northwest corner of Jensen Avenue and Elm Avenue and the northeast corner of Jensen Avenue and MLK Jr Boulevard for $4,750. The Fourth and Fifth Amendments were executed to extend the Consultant’s performance period to complete their services to October 30, 2023. No additional compensation was provided with the Fourth and Fifth amendments.

 

The design for the Jensen Avenue Overlay Project from State Route 41 to Martin Luther King Jr. Boulevard is nearly complete and preparing to advertise for bid in the coming months. Through the final design coordination, City staff and the Consultant have identified the need for additional design services to address unforeseen utility conflicts and to provide additional project management support. Therefore, the City now desires to amend the scope of the Agreement to redesign the proposed improvements and prevent utility relocation efforts.  The staff negotiated the additional scope to the contract for an increase of $5,928, which brings the total contract amount to $86,998 and the total allocation within the contract for Jensen Overlay to $53,708.

 

The City Attorney’s Office has reviewed and approved the amendment as to form.

 

ENVIRONMENTAL FINDINGS

 

By the definition provided in the California Environmental Quality Act (CEQA) Guidelines Section 15378 the contract amendment approval does not qualify as a project as defined by the CEQA.

 

LOCAL PREFERENCE

 

Local preference was not implemented; this is an amendment to an existing agreement.

 

FISCAL IMPACT

 

The project, which is located in Council District 3, will not have any impact to the General Fund.  The amendment amount of $5,928 will be funded by the RSTP federal grant and Proposition 111 Special Gas Tax funds. All funds necessary for the contract amendment are included in the current fiscal year budget as previously adopted by the Council.
