RECOMMENDATIONS

 

Staff recommends that the City Council approve extending the contract by two (2) one-year terms for an amount not to exceed $359,616 per year for the Requirements Contract for Business Corridor Litter Abatement Services with ScrubCan, Inc. of Fresno, for a total contract value not to exceed $1,078,848.

 

EXECUTIVE SUMMARY

 

On April 27, 2023, City Council awarded a requirements contract for Business Corridor Litter Abatement Services to ScrubCan, Inc. of Fresno for $113,760 for a term of one year. On August 10, 2023, Council approved Contract Change Order No. 1 in the amount of $245,856 to add the Olive Avenue, Linden Avenue, Wishon Avenue, Fern Avenue and Van Ness Avenue business corridors in the Tower District, bringing the total contract value to $359,616.

 

This extension for two (2) one-year terms will allow for currently funded services to continue for an amount not to exceed $359,616 per year, if mutually agreeable and funding is available, as per the terms and conditions of the original requirements contract, and to allow for the services contained in this contract to be utilized in additional areas within the City of Fresno in the event funding is identified.

 

BACKGROUND

 

On January 27, 2022, the City Council authorized the Public Works Department to submit a Grant Application to the California Department of Transportation for the Clean California Local Grant Program (CCLGP); a program created to beautify and clean up local streets and roads, tribal lands, parks, pathways, transit centers, and other public spaces. The program is part of the nearly $1.1 billion Clean California initiative that aims to assist the California Department of Transportation (Caltrans) in addressing the continuous trash generation overwhelming California’s public spaces.

The Public Works Department was awarded the grant in May of 2022 for the Project which includes both infrastructure and non-infrastructure elements focused on urban greening, improved walkability, community placemaking, and litter cleanup. The amount of the grant, which extends through June 30, 2024, is $5,000,000, with $250,000 designated for a litter abatement contract with an outside vendor, for the business corridors within the scope of the grant.

 

The original project included litter abatement along Blackstone Avenue, Abby Street corridors and the Belmont Ave. corridor.   On August 10, 2023, Council approved Contract Change Order No. 1 in the amount of $245,856 to add the Olive Avenue, Linden Avenue, Wishon Avenue, Fern Avenue and Van Ness Avenue business corridors in the Tower District, bringing the total contract value to $359,616.

 

ScrubCan, Inc. is a local minority-owned business with experience in commercial cleaning services. ScrubCan, Inc. holds the contract for janitorial services with the City of Fresno, as well as serving as the contractor for the City’s Highway Litter Abatement Program, since August of 2022. The City of Fresno and Caltrans are pleased with their performance. 

 

ENVIRONMENTAL FINDINGS

This contact change order no. 2 is not subject to environmental findings because this is for additional contracting authority to maintain existing City sidewalk infrastructure. The original contract was awarded with a categorical exemption by City Council on April 27, 2023.

LOCAL PREFERENCE

 

Local preference was not implemented because this is an existing contract. Nonetheless, ScrubCan, Inc. is a locally owned and operated company.

 

FISCAL IMPACT

 

This contract is funded by the General Fund. The funding allocations necessary for this Contract are included in the current fiscal year adopted City budget. This contract crosses fiscal years, and would utilize funding made available in the FY2025 adopted budget. This is a requirements contract which does not commit the City to procure any certain level, and services will be adjusted in accordance with approved appropriations.
