RECOMMENDATION

 

Staff recommends the City Council adopt a resolution amending the Implementing Policies for the Citywide Regional Street and New Growth Area Major Street Impact Fees as previously adopted by Resolution No. 2007-291 and as amended by Resolutions 2008-278, 2008-349, 2013-27, and 2016-259.

 

EXECUTIVE SUMMARY

 

The Implementing Policies for the Major Street Impact Fee Program need to be amended to allow the deferral of the Citywide Regional Street and New Growth Area Major Street Impact Fees to the time of Certificate of Occupancy. Other development impact fees for Police, Fire, Parks and Traffic Signals are already deferrable to the time of occupancy.

 

BACKGROUND

 

The current Major Street Impact fees are due at time of Building Permit Issuance while the impact fees for Fire, Police, and Parks are due at time of Certificate of Occupancy. Allowing the Major Street Impact Fees to be deferred to the time of Certificate of Occupancy will give developers the opportunity to lessen the amount of upfront cost at the time of building permits.  

 

ENVIRONMENTAL FINDINGS

 

Pursuant to the California Environmental Quality Act (CEQA) Guidelines Section 15378, this item is not a project for the purposes of CEQA.

 

LOCAL PREFERENCE

 

Local preference was not implemented because this item does not include a bid or award of a construction or services contract.

 

FISCAL IMPACT

 

There will be no impact to the City’s General Fund as the fees will only be deferred to be paid at the time of Certificate of Occupancy.
