RECOMMENDATION
 
Staff recommends the Council introduce the attached resolution granting authority to the Public Works Director to delegate the authority to other City Departments for the approval of contract change orders for on-site Public Works of Construction.
 
EXECUTIVE SUMMARY
 
From time to time, other City Departments wish to perform the construction management services for their own on-site public works of construction. Currently, the City has designated the Public Works Director to be the authority over Capital construction projects and the signing authority for Change Orders.
This Resolution will allow for the Public Works Director to delegate the authority for approval of Change Orders to other City Department Directors on a case by case basis and only for projects not in the street right-of-way.
 
BACKGROUND
 
In 1984, Council adopted Resolution 84-142 establishing the processes for Public Works of Construction Change Order procedures for the City of Fresno. These procedures accounted for changes in scope and price and limited their approval based upon cost to the Public Works Director, Chief Administrative Officer for the City or the City Council.
In following years, Council approved Resolutions 89-470 and 94-114 that raised the limits of the authority for changes orders and included the addition of time to construction projects under the Change Order Authority. In those two instances, the authority was never delegated to anyone but the Public Works Director to initiate the Change Order process.
Occasionally, other City Departments wish to perform the construction management services for their own on-site public works of construction. To allow for other Departments to have the option of utilizing a third party Construction Management Firm on their on-site projects, the authority for Changes Orders needs to be able to be delegated to these prospective Department Directors.
The attached Resolution will allow for the Public Works Director to grant authority, on a case by case basis, the authority to other Department Directors the approval of Change Orders on on-site projects in the place of the Public Works Director. The written permission will be given by the Public Works Director being signatory to the Council Report which will enable the other Departments to hire their third party construction management services. The Resolution also allows for the other Department Directors to sign construction contracts and resolve claims and disputes. It also requires that the delegated Department follow prevailing wage monitoring requirements and have a person who is in responsible charge of the work as required by the State of California Business and Professions Code Section 6700.
This Resolution has been reviewed and approved as to form, by the City Attorney's Office.
 
ENVIRONMENTAL FINDINGS
 
Pursuant to the provisions of CEQA Guidelines Section 15738, this Resolution is not a project for purposes of CEQA.
 
LOCAL PREFERENCE
 
Local preference not implemented because approval of a Resolution is not an award of services or construction project.
